Explanation
Hard Road on the northwest side of the city is in the process of being widened from Smoky Row Road to Linworth Road. Work includes widening from two to five lanes with curb, sidewalks, enclosed drainage, signal upgrades, a new signal at Saddle Run, bike lanes, and a grade separation with the CSX railroad. In order to obtain OPWC funding, construction on this project had to start before June 1, 2003. By May 2003, the private utilities had not relocated their facilities. According to terms agreed upon with the Ohio Department of Transportation before the project was sold, delays incurred due to utilities would not be reimbursable. The City elected to bid the project before the relocation of the utilities was completed in order to retain the OPWC funding. Since the start of construction in July 2003, the City's contractor has incurred delay time because utilities were in the way. Currently, the cost of these delays is $200,000.00. This construction contract modification is needed to pay the contractor for utility delays. This is the first modification to this contract. The total contract amount with this modification will be $11,984,104.79.
This legislation authorizes the transfer of $200,000.00 from fund 704, the 1995, 1999 Voted Streets and Highways Fund to Fund 765, the Federal/State Highway Engineering Fund; the appropriation of $200,000.00 from Fund 765; and authorizes the expenditure of $200,000.00 from Fund 765 to modify and increase the existing construction contract with Trucco Construction Company Inc. for the Hard Road Phase B project.
Trucco Construction Company Incorporated's contract compliance number is 31-1293605 and expires June 26, 2005.
Fiscal Impact: The Transportation Division budgeted $450,000 in the 2004 Capital Improvements Budget for utilities relocation for Hard Road Phase B under the Federal/State Match project. A previous ordinance authorized the expenditure of the remaining $200,000.00.
