Title: To amend Ordinance No. 0108-2008, passed January 29, 2009, by correcting the name of the funding source, and to declare an emergency.
Explanation

Ordinance No. 0108-2008, passed January 26, 2009, authorized the Director of Recreation and Parks to enter into a construction contract with Shaw and Holter, Inc./Owbow River and Stream Restoration in connection with the Clover Groff Stream Restoration Phase I project. Funding for this project was stated within original legislation to come from the Ohio Water Development Authority (OWDA). It has since been determined that the funding for this project comes from Ohio Environmental Protection Agency (OEPA) Water Resource Restoration Sponsor Program (WRRSP). The funding will be listed as WPLCF # CS 392465-01, and WRRSP # CS 399026-01. The legislation should have referenced that this is an OEPA WRRSP funded project and the original ordinance was incorrect. This ordinance amends 0108-2008 to correct the name of the funding source.

Emergency action is requested in order to keep the project on schedule for completion prior to loan deadline.

Body

WHEREAS, on January 29, 2009, Columbus City Council passed Ordinance No. 0108-2008, authorizing the Director of Recreation and Parks to enter into contract with Shaw and Holter, Inc. / Oxbox River and Stream in conjunction with the Clover Groff Stream Restoration-Phase I project; and

WHEREAS, it has since been determined that the name of funding source in the ordinance was incorrect; and

WHEREAS, the correct name of the funding source for this project should be the Ohio Environmental Protection Agency WRRSP # CS 399026-01, WPLCF # CS 392465-01 and:

WHEREAS, the project will be administered by OWDA and payments will come from the OWDA directly to contractor; and

WHEREAS, this ordinance amends 0108-2008 to correct the name of the organization funding this project; and

WHEREAS, an emergency exists in the usual daily...
