AMENDMENT:  Z03-079A
 
Ordinance #0439-2004, passed on June 28, 2004 (Z03-079), rezoned 2.44± acres located at 1120 Georgesville Road from the R, Rural District to the L-C-2, Limited Commercial District to permit a church or commercial uses.  This legislation will amend Ordinance #0439-2004, passed on June 28, 2004, to modify Section 1 by including the legal description approved by the City of Columbus for rezoning application Z03-079.

To amend Ordinance #0439-2004, passed on June 28, 2004 (Z03-079), for property located at 1120 GEORGESVILE ROAD (43228), by amending Section 1 of the ordinance to add the approved legal description for the 2.44± subject site (Z03-079A).
 
 
 
Body
 
WHEREAS, Ordinance #0439-2004, passed on June 28, 2004 (Z03-079), established the L-C-2, Limited Commercial District on property located at 1120 GEORGESVILE ROAD (43228), and
 
WHEREAS, it is necessary to amend Section 1 of said Ordinance to add the approved legal description for the 2.44± subject site, and
 
WHEREAS, this amendment modifies Section 1 of ordinance #0439-2004, and affects only the legal description of the 2.44± subject site and in no other way alters ordinance #0439-2004; and
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That Section 1 of Ordinance #0439-2004, passed on June 28, 2004 (Z03-079), be repealed and replaced to read as follows:
 
        SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1120 GEORGESVILLE ROAD (43228), being 2.44± acres located on the east side of Georgesville Road, at the terminus of Hall Road, and being more particularly described as follows:
 
LEGAL DESCRIPTION FOR 1120 GEORGESVILLE ROAD, 2.44± ACRES
 
Real estate situated in the County of Franklin, in the State of Ohio, and in the Township of Franklin, bounded and described as follows:
 
Being part of Virginia Military Survey No. 1462 and being a part of the 98.72 acre tract and being more particularly described as follows:
 
Beginning at a spike in the center line of Georgesville Road North 16º 53' East 21.0 feet from the intersection of the center line of Georgesville Road and Hall Road; thence south 77º 15' East 924.40 feet, passing iron pins at 29.0 feet; 300.00 feet and 650.0 feet to an iron pin; thence south 13º 46' West 165.93 feet to an iron pin in the center of a small creek; thence north 54º 40' West 190.0 feet to a point; thence north 68º 21' West 110.00 feet to a point; thence north 82º 21' West 400.00 feet to a point; thence south 55º 59' West 356.59 feet to a spike on the center line of Georgesville Road; thence north 8º 29' East 141.61 feet along the chord of a curve to a spike on the center line of said road; thence north 16º 53' East 227.55 feet along the said center line, passing a spike at 206.55 feet to the place of beginning, containing 2.969 acres, more or less.

Beginning at an iron pin in the Grantor's south-westerly property corner, said point being 6.36 feet left of and radially from Station 72 + 15.10 in the proposed centerline of Georgesville Road; thence along the Grantor's westerly property line North 8º 25' 00" East a distance of 142.09 feet to a point; thence continuing along the Grantor's Westerly property line, passing a Railroad spike at 206.93 feet, North 19º 02' 52" East a distance of 227.55 feet to the Grantor's northwesterly property corner.  said point also being in the northerly Virginia Military Survey Line 13950 (AKA 14506)
 
Thence along the Grantor's northerly property line and said northerly Virginia Military Survey Line, crossing the proposed centerline of Georgesville Road at 1.26 feet, and further crossing an iron pin in the existing easterly Right of Way of Georgesville Road, South 75º 58' 11" East a distance of 51.44 feet to a point in the proposed easterly Right of Way line of Georgesville Road;
 
Thence with said line South 18º 54' 20" West a distance of 87.41 feet to a point; thence South 3º 21' 10" West a distance of 146.64 feet to a point; thence South 11º 49' 49" West a distance of 48.73 feet, to a point in the Grantor's southerly property line.
 
Thence along said property line, crossing the existing easterly Right of Way line of Georgesville Road and further crossing the proposed centerline of Georgesville Road at 109.95 feet, South 55º 55' 00" West a distance of 118.47 feet to the place of beginning, containing 23,020 square feet more or less, of which the present road occupies 10,367 square feet more or less.
 
SECTION 2.  That the existing Section 1 of Ordinance #0439-2004, passed on June 26, 2004 (Z03-079) is hereby repealed.
 
SECTION 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
