Explanation
Background: The Transportation Division is responsible for maintaining the City's roadway system through a viable renovation program. A brick rehabilitation project is needed to prevent premature deterioration of the City's brick roadways. The contract will consist of replacing brick pavement on targeted City streets. The attached list of brick roadways will be used to select the final locations for brick rehabilitation. The Transportation Division capital improvement project inspection section will perform inspection services at a cost not to exceed $162,180.99. This project was bid in compliance with the City Code and advertised in the City Bulletin. Formal competitive bids were received and tabulated on March 3, 2005 by the Transportation Division. Four (4) bid proposals were received as follows:

The Transportation Division recommends the bid award to McDaniel's Construction Corporation, Incorporated, contract compliance number 31-1145406 (expires May 17, 2007) as the lowest, best, most responsive, and most responsible bidder.
The bid proposal stated that the bid quantities were estimated and that the bid quantities may be increased or decreased, depending on the funds available. Due to the better-than-expected unit prices in the submitted bids, an increased amount of brick rehabilitation work can be completed without exceeding budget. Contract quantities were increased without changing the ranking of the bids received. Based upon the revised quantities and the bid unit costs the new contract amount would be:

Fiscal Impact: The Transportation Division budgeted $150,000 in the 2004 Capital Improvements Budget for Brick Rehabilitation. This ordinance will increase funding and authorize an expenditure of $1,243,387.60. Funds in the amount of $1,237,929.91 are available within the Transportation Division's 2004 Capital Improvement Budget in the 1995, 1999 Voted Streets and Highways Fund in the Resurfacing and Urban Infrastructure projects. This ordinance transfers these funds to the Brick Rehabilitation project where, in addition to the $5,457.69 already in that project, they are authorized for expenditure.
This ordinance amends the 2004 Capital Improvements Budget to allow for this expenditure. The brick street rehabilitation project is being increased by $1,240,057 from $150,000 to $1,390,057 with corresponding decreases in the downtown streetscape improvements project ($800,000) and the economic and community development project ($440,057) that total $1,240,057. This amendment accurately reflects past and planned expenditures from these projects.
Emergency action is requested to allow this project to proceed and be completed this construction season.

WHEREAS, the Transportation Division is responsible for maintaining the City's roadways; and
WHEREAS, brick rehabilitation is needed to prevent early deterioration of the City's brick roadways; and
WHEREAS, formal competitive bids were received and tabulated on March 3, 2005, by the Transportation Division for the Brick Rehabilitation - 2005 project and a satisfactory low bid was received; and
WHEREAS, funds are budgeted and available for this expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that this contract should be awarded so that the work may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

SECTION 3. That the Public Service Director be and hereby is authorized to enter into a contract with McDaniel's Construction Corporation, Incorporated, 1069 Woodland Avenue, Columbus, Ohio 43219 for the Brick Rehabilitation - 2005 project in an amount not to exceed $1,081,206.61 in accordance with the applicable specifications and plans on file in the office of the Transportation Division Administrator, which are hereby approved, and to provide for construction inspection services in the amount of $162,180.99.
SECTION 4. That for the purpose of paying the cost of the contract, the sum of $1,243,387.60, or so much thereof as may be necessary, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 530105.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
