Explanation
 
The State of Ohio is currently reconstructing the Sunbury Road/State Route 161 Interchange as a part of their greater S.R. 161/Interstate 270 Interchange improvements.  The existing traffic signals at this interchange are part of a series of Sunbury Road traffic signals currently maintained by the State of Ohio.  The proposed reconstruction of this interchange will move one of these signals from Blendon Township south into the City of Columbus.  Once this interchange is reconstructed the City will be legally responsible for the maintenance of the traffic signals relocated within its corporate boundary.  The Public Service Department, Transportation Division, the State of Ohio, and Franklin County officials all believe the public will best be served if the State continues to maintain all of the traffic signals in this series.  To achieve this objective the Public Service Department would like to submit a detachment petition to the Franklin County Commissioners that would detach 0.63 acres of existing Sunbury Road right-of-way to Blendon Township.  If the City of Columbus does not detach this area the City will need to enter into a signal maintenance agreement for this one signal with the State of Ohio for which the State would require annual compensation from the City.  The following legislation authorizes the Public Service Director to sign the necessary petition.
 
Fiscal Impact: The City will need to enter into a signal maintenance agreement with the State of Ohio for the signal relocated within its corporate boundary if the City does not detach this area.  The State of Ohio will require annual compensation for the cost of maintaining this signal.

WHEREAS, the existing traffic signals at this interchange are part of a series of Sunbury Road traffic signals currently maintained by the State of Ohio; and
 
WHEREAS, the proposed reconstruction of this interchange will move one of these signals from Blendon Township south into the City of Columbus; and
 
WHEREAS, once this traffic signal is reconstructed within the Columbus city limits the City will be legally responsible for its maintenance; and
 
WHEREAS, the Public Service Department, Transportation Division, the State of Ohio, and Franklin County officials all believe the public will best be served if the State continues to maintain all of the traffic signals in this series; and
 
WHEREAS, to achieve this objective the Public Service Department would like to submit a detachment petition to the Franklin County Commissioners that would detach 0.63 acres of existing Sunbury Road right-of-way to Blendon Township; and
 
WHEREAS, if the City does not detach this area the City will need to enter into a signal maintenance agreement for this one signal with the State of Ohio for which the State would require annual compensation from the City; and
 
WHEREAS, it is in the best interest of the City of Columbus to authorize and direct the Public Service Director or his designee to act as the authorized agent of the City of Columbus and file the aforementioned petition for detachment, thereby preserving the public health, peace, property, safety, and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director or his designee is hereby authorized to serve as the authorized agent of the City of Columbus and hereby directed to file a petition with the Franklin County Board of County Commissioners for the detachment of certain territory located within and owned solely by the City of Columbus containing 0.63 acres from the City in accordance with the provisions of Section 709.38 of the Ohio Revised Code.
 
Section 2.  That the territory to be detached from the City of Columbus is described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, and being a part of United States Military Lands, Quarter Township 4, T2N, R17W, and also being particularly described as follows:
Beginning the intersection of the existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 3050-88, shown of record in Official Record Number 12921 A01, Recorder's Office, Franklin County, Ohio, and the easterly right-of-way of Sunbury Road, also being a property corner;
Thence southerly along said easterly right-of-way of Sunbury Road, approximately 121.9 feet, to an angle point in the right-of-way of Sunbury Road, also being a property line;
Thence westerly along said easterly right-of-way of Sunbury Road, approximately 8.6 feet;
Thence southerly along said easterly right-of-way of Sunbury Road, approximately 28 feet;
Thence westerly crossing Sunbury Road, approximately 175 feet, to the westerly right-of way of Sunbury Road, also being a property line;
Thence northerly along said westerly right-of-way of Sunbury Road, approximately 150 feet, to a corner of said existing City of Columbus Corporation Line, as established by Columbus Ordinance 3050-88;
Thence easterly along said existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 3050-88, and crossing Sunbury Road, approximately 200 feet, to the place of beginning, containing 0.63 acres, more or less.
