Explanation
BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. for the construction, inspection, and staking of a water main on South Fifth Street, between Town Street and Rich Street. The City of Columbus agreed to pay a guaranteed maximum reimbursement of $228,000. The City originally planned to construct this project in the future. The developer recently purchased ground and needs the water main sooner than the City was planning to design, procure, and construct. The developer has agreed to construct the line at their cost and then obtain reimbursement from the City due to the more immediate need.
Emergency action is requested as the construction of the water main cannot happen until the City has entered into an executed agreement with Blue Heron Land Co. Any delay in this process will cause a delay for potential property owners in obtaining occupancy.

To authorize the Director of Public Utilities to enter into a Guaranteed Maximum Reimbursement agreement with Blue Heron Land Co. pursuant to Section 186 of the Columbus City Charter for the construction, inspection, and staking of a water main on South Fifth Street; for the Division of Power and Water; to amend the 2007 Capital Improvements Budget; to authorize the transfer and expenditure of $228,000 from the Water Works Enlargement Voted 1991 Bonds Fund, and to declare an emergency.
