Explanation
BACKGROUND: This ordinance authorizes the Director of Public Utilities to modify and increase a construction contract with Complete General Construction Co. for Street Lighting Improvements for OSU Off-Campus Core Area for the Division of Power and Water (Power). It is requested that the contract be modified to cover unforeseen field conditions due to the dense amount of on-street parking within the project limits and associated charges to relocate vehicles to a lot provided by the University Community business Association at the Northeast corner of East Eight Avenue and North High Street.

2. Reasons additional goods/services could not be foreseen:
After review of the contract plans and specifications it was determined that on-street parking would hamper the contractor's ability to finish construction without exorbitant delays. The Division of Power and Water and Transportation Division, Inspection Services Section, worked with the OSU community to determine the best course of action.
3. Reason other procurement processes are not used:
Due to this contract playing a vital role in enhancing public safety in the OSU Off-Campus Core Area through upgrading the existing street lighting system, it is in the best interest of the citizens of Columbus to modify the existing contract to expedite construction.
4. How cost of modification was determined:
The towing cost was reviewed and negotiated by the Transportation Division, Inspection Services staff and the contractor. A recommendation was made to accept the unit price of $73.50 and the Division of Power and Water (Power) staff approved their analysis.

FISCAL IMPACT: This expenditure was not budgeted in the Electricity Operating Fund, however, there is sufficient budget authority due to lower than anticipated expenditures in Object Level One: 03. There were no similar expenditures in the past two years.

To authorize the Director of Public Utilities to modify an existing contract with Complete General Construction Co. to provide for additional costs incurred due to the dense amount of on-street parking within the OSU Off-Campus Core Area Street Lighting Project area; and to authorize the expenditure of $99,960.00 from the Electricity Operating Fund. ($99,960.00)

WHEREAS, Contract No. EL007012, for Street Lighting Improvements in the OSU Off-Campus Core Area was authorized by Ordinance No. 0731-2007, passed June 4, 2007, executed on June 6, 2007, and approved by the City Attorney on June 27, 2007; and
WHEREAS, a modification to the contract is needed to add one Reference and Item Number to cover unforeseen field conditions due to the dense amount of on-street parking within the project limits and associated charges to relocate vehicles to a lot provided by the University Community Business Association at the Northeast corner of East Eighth Avenue and North High Street; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Utilities is hereby authorized and directed to modify and increase an existing construction contract with Complete General Construction Co., for additional services required due to dense on-street parking within the project limits of Street Lighting Improvements for OSU Off-Campus Core Area, in the amount of $99,960.00.
SECTION 2. That this contract modification is in compliance with Section 329.16 of Columbus City Codes, 1959.
SECTION 3. That to pay the cost of the aforesaid contract modification, the expenditure of $99,960.00, or so much thereof as may be needed, is hereby authorized from the Electricity Operating Fund No. 550, Division No. 60-07, OCA 606772, Object Level One 03, Object Level Three 3355.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
