Explanation
1. BACKGROUND: This legislation authorizes the Director of Public Utilities to enter into an agreement with Korda/Nemeth Engineering, Inc., for professional engineering services for Northeast Area Neighborhood Stormwater System Improvements. This project will mitigate poor drainage within this area.
2. ENGINEERING CONTRACT AWARD: Korda/Nemeth Engineering, Inc. was selected in accordance with the procedures set forth in Columbus City Code, Section 329.13, "Awarding professional service contracts through requests for Statements of Qualifications". Twenty-five statements of qualifications were received and opened on October 27, 2006. Requests for Cost Proposals (RFP's) were sent to three (short-listed) firms having the experience necessary to complete the project; Korda/Nemeth Engineering, Inc., Pomeroy & Associates LTD., and Jones-Stuckey Ltd., Inc All three consultants submitted RFP's on July 13, 2007.
Upon review of the technical proposals, the bidders were ranked using criteria specified in City Code, and more specifically: proposal quality/feasibility, competence to perform required work, project schedule, and location of the workforce.
Based upon these criteria, Korda/Nemeth Engineering, Inc. was selected as the highest-ranked bidder. Their Contract Compliance Number is 31-0922991, expires 09/28/09, majority.
3. FISCAL IMPACT: This legislation includes a transfer within the Storm Sewer Bonds Fund to provide sufficient funding for the project, as well as an amendment to the 2007 Capital Improvements Budget to provide sufficient budget authority.

To authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Korda/Nemeth Engineering, Inc.; for the Division of Sewerage and Drainage; to authorize the transfer of $152,152.00 within the Storm Sewer Bond Fund; to amend the 2007 Capital Improvements Budget and to authorize the expenditure of $152,152.00 within the Storm Sewer Bond ($152,152.00).

WHEREAS, Requests for Cost Proposals were received and opened on July 13, 2007 for engineering services for the Northeast Area Neighborhood Stormwater System Improvements Project; and
WHEREAS, Korda/Nemeth Engineering, Inc., was selected based on the following criteria: proposal quality/feasibility, competence to perform required work, project schedule, and location of the workforce; and
WHEREAS, it is necessary to transfer money within the Storm Sewer Bond Fund for the Northeast Area Neighborhood Stormwater System Improvements Project; and
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditure; and
WHEREAS, it has become necessary in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, to authorize the Director of Public Utilities to enter into an agreement for professional engineering services to mitigate poor drainage and other stormwater problems for the Northeast Area Neighborhood Stormwater System Improvements Project, for the preservation of the public health, peace, property, and safety; now therefore.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor is hereby authorized to transfer $152,152.00 within the Storm Sewer Bonds Fund, Fund 685, Division of Sewerage and Drainage, Division 60-15, Object Level One 06, Object Level Three 6682, as follows:

SECTION 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 3. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That the Director of Public Utilities be and hereby is authorized to execute an agreement with Korda/Nemeth Engineering, Inc., 1650 Watermark Drive, Suite 200, Columbus, Ohio 43215, for the Division of Sewerage and Drainage, for professional engineering services in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
SECTION 6. That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Sewerage and Drainage.
SECTION 7. That for the purpose of paying the cost of the professional engineering services contract, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows: Division 60-15, Fund 685, Project 610759, Object Level One 06, Object Level Three 6682, OCA Code 685759, Amount $152,152.00.
SECTION 8. That the 2007 Capital Improvements Budget Ordinance No. 1108-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the construction contract stated in Section 1 herein:
