Explanation
 
Background:  This legislation authorizes a modification to the design contract with E.P. Ferris and Associates, Inc.  The design contract is for various engineering and survey tasks along with  traffic studies for the placement of traffic calming features.  The location of this work is roughly within an area bounded by the Olentangy River, Interstate 670, 9th Avenue, and High Street.  
 
The design process involved more public meetings and traffic counts than were anticipated.  This modification will provide for the additional meetings with the public, changes to the contract construction plan format, and additional traffic studies.
 
Portions of the project are under construction.  Additional design work is necessary before the remaining features can be constructed.  The remaining features will be completed in three separate groups for construction.  It is anticipated that the three groups will begin construction in the spring, summer, and fall of 2008.
 
The city entered into Contract No. EL004073-001 with E. P. Ferris and Associates, Inc., contract compliance number 311194974 (expiring 11/16/09 ), on February 13, 2004 for $325,000 for the preparation of contract construction plans for SSI-OTMP.  Ordinance No. 2360-2003 passed November 10, 2003.  The total amount of this modification is $275,000.00. The total amount of the contract, including all modifications, is $600,000.00.  
 
Fiscal Impact:  Funds in the amount of $275,000.00 for this project are budgeted within the 2007 Capital Improvement Budget and are  available from the 2007 bond sale.
 
Emergency Justification:  Emergency action is requested in order to authorize the consultant to continue work as soon as possible.  Additional traffic calming features are expected to begin construction in the spring of 2008 if the consultant receives authorization to proceed in December.

Body
 
WHEREAS, contract number EL004073-001 was authorized by Ordinance Number 2306-2003 passed November 10, 2003, and the contract was executed February 13, 2004 for engineering and surveying tasks, and traffic studies for the design of traffic calming features for the Spring Sandusky Interchange - Overall Traffic Management Plan (SSI-OTMP), and
 
WHEREAS, it is necessary to modify and increase the contract to provide for additional meetings, changes to the contract construction plan format, and additional traffic studies, and
 
WHEREAS,  an emergency exists in the usual daily operation of the Public Service, Transportation Division, in that it is immediately necessary to recommence design work , thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public service be and is hereby authorized to modify and increase Contract No. EL004073-001 with E.P. Ferris and Associates, Inc., 880 King Avenue, Columbus, Ohio 43212 in an amount not to exceed $275,000.00 for the additional work necessary to provide for additional meetings with the public, changes to the contract construction plan format, and additional traffic studies.
 
SECTION 2.  That for the purpose of paying for the cost thereof, the sum of $275,000.00 or so much thereof as may be needed is hereby authorized to be expended from the Voted 1995, 1999, 2004 Streets and Highways Fund, No. 704, Dept./Div. 59-09, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385, Project Number 590127.
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
