Explanation
Need: In 2007, $2,800,388.00 was appropriated within the Federal, State, and Mandatory Law Enforcement Contraband/Seizure Funds via ord. 0685-2007 and ord 1404-2007. An additional appropriation of $139,900.00 is now needed from the unappropriated balance of the State Law Enforcement Contraband Seizure Funds for the Division of Police. Funds were received from seized and forfeited property and must be used solely for law enforcement purposes as specified in Ordinance 1850-85. These funds are needed to purchase various services, supplies, and equipment.

FISCAL IMPACT:
Since these funds to be appropriated are from the Law Enforcement Contraband/ Seizure Fund, there will be no effect on the financial status of the General Fund.

To authorize an appropriation of $139,900.00 from the unappropriated balance of the Law Enforcement Contraband Seizure Fund to the Division of Police, to provide for services, equipment, and claims; and to declare an emergency. ($139,900.00)

WHEREAS, monies were received from seized and forfeited property; and
WHEREAS, funds received from these forfeitures must be solely used for law enforcement purposes as specified in Ordinance #1850-85; and
WHEREAS, an emergency exists as it is immediately necessary to appropriate funds in the Law Enforcement Contraband Seizure Funds in order to purchase supplies, services, and equipment for the Division of Police for the preservation of public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
SECTION 1. That from the unappropriated monies in the Law Enforcement Contraband Seizure Fund, Fund No. 219, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2007 the sum of $139,900.00 is appropriated to the Division of Police, #30-03 as follows:

SECTION 2. That the monies appropriated in the foregoing Section 1 shall be paid upon order of the Public Safety Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
