Explanation
The Public Service Department, Transportation Division, is engaged in that project identified as the General Engineering Sidewalk Installation 2007 project. The purpose of this project is to install sidewalks where none exist throughout the city. Installation of these sidewalks may require the acquisition of additional right-of-way in some locations. To conserve time, the Public Service Department, Transportation Division, desires to establish a $100,000.00 sidewalk right-of-way acquisition contingency fund to be used by the City Attorney's Real Estate Division staff in those cases where additional right-of-way must be acquired.
Fiscal Impact: Funds are budgeted and available in the Voted 1995, 1999, 2004 Streets and Highways Fund to establish a $100,000.00 sidewalk right-of-way acquisition contingency fund that will be used by the City Attorney's Office, Real Estate Division, to acquire additional right-of-way for sidewalk installation throughout the City.

To authorize the establishment of a $100,000.00 contingency fund for the purpose of paying for the acquisition of additional right-of-way for miscellaneous sidewalk installations, and to authorize the City Attorney's Office, Real Estate Division, to expend $100,000.00 from the Voted 1995, 1999, 2004 Streets and Highways Fund for such acquisition when requested to do so by the Public Service Department, Transportation Division. WHEREAS, the Public Service Department, Transportation Division, is engaged in that project identified as the General Engineering Sidewalk Installation 2007 project, and
WHEREAS, the purpose of this project is to install sidewalks where none exist throughout the city, and
WHEREAS, installation of sidewalks may require the acquisition of additional right-of-way in some locations; and
WHEREAS, to conserve time, the Public Service Department, Transportation Division, desires to establish a $100,000.00 sidewalk right-of-way acquisition contingency fund to be used by the City Attorney's Real Estate Division staff in those cases where additional sidewalk right-of-way must be acquired; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS;
SECTION 1: That the City Attorney's Office, Real Estate Division, be and hereby is authorized to acquire additional right-of-way for sidewalk installations as a part of the General Engineering Sidewalk Installation 2007 project.
SECTION 2: That the City Attorney be and hereby is authorized to expend $100,000.00, or so much thereof as may be necessary from the Voted 1995, 1999, 2004 Streets and Highways Fund, Department 59-09, Transportation Division, O.L. 01/03 Codes, 06/6601, OCA Code 644385, Project 590105 (Pedestrian Safety Improvements) for this purpose.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
