Explanation           
 
Background:  This legislation authorizes the Public Service Director to modify and increase a Reimbursement Agreement established in ordinance 1318-2006 and modified and increased in ordinance 0773-2007 with Empire Ventures/6200 E. Broad Street, LLC ("Continental").  The East Broad Street Improvement project is a phased project with funding coming from the City and five private entities.  The list of projects was developed as a "Pay As You Grow" area related to the redevelopment of the Lucent site by Mt. Carmel.  $110,000.00 is needed for the next phase of the detailed design.  The formal competitive bidding requirements of Chapter 329 of the City Code were waived in previous ordinances and are requested to be waived for this additional funding for the procurement of final engineering services pursuant to this Reimbursement Agreement.
 
Fiscal Impact:  Funds for this project are budgeted and available within the 2007 C.I.B. from the 1995, 1999, 2004 Voted Streets and Highways Fund.
 
Emergency action is requested so that this project can proceed in a timely manner and keep commitments made to the local community. Final Engineering was partially funded and in progress. It is necessary to set up these additional funds to fund the remaining Final Engineering.

To authorize the Public Service Director to modify and increase a Reimbursement Agreement with Empire Ventures/6200 East Broad Street, LLC ("Continental") for the final design of the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road; to waive the competitive bidding requirements of the Columbus City Code, 1959; to authorize the expenditure of $110,000.00 from the 1995, 1999, 2004 Voted Streets and Highways Fund; and to declare an emergency.  ($110,000.00)
 
Body
 
WHEREAS, the need exists to modify and increase the Reimbursement Agreement for the final design of the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road;  and
 
WHEREAS, it is in the best interest of the city to waive the formal competitive bidding requirements of the Columbus City Code, 1959, and that this agreement be awarded in accordance with Section 186 of the Columbus City Charter; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department in that it is immediately necessary to provide consent for these projects so it can proceed according to established time lines, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and is hereby authorized to modify and increase the Reimbursement Agreement with Empire Ventures/6200 E. Broad Street, LLC ("Continental") for the final design of the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road for the Transportation Division in the amount of $110,000.00 pursuant to Section 186 of the Columbus City Charter.
 
SECTION 2.  That in accordance with Section 329.27 of the Columbus City Code, City Council has determined that it is in the best interest of the City of Columbus that the formal competitive bidding requirements of Chapter 329 be and are hereby waived for the procurement of final engineering services pursuant to this Reimbursement Agreement.
 
SECTION 3.  That the expenditure of $110,000.00, or so much thereof as may be necessary be and is hereby authorized and approved as follows:

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 5.  That for the reasons stated in the preamble hereto which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
