Explanation

 

Background:  This legislation authorizes a modification to the design contract with ms consultants, inc.  for the Morse Road Project. This project is being designed to encourage redevelopment and stabilize a vibrant community.  This project includes the addition of a landscaped median, curb and gutter drainage, street side trees, sidewalks, bike lanes, streetlights and signal system upgrades as prescribed by the Morse Road Design Study adopted by Council on December 11, 2000.  This will improve the aesthetics of the corridor, encourage the flow of vehicular, pedestrian and bicycle traffic and invite redevelopment.

 

This contract modification is necessary to revise the Morse Road Project Phase 2 plans to modify Right-of-Way plans to accommodate changes required by Right-of-Way negotiations, to redesign the sewer at the corner of Cleveland Avenue at Morse Road to coordinate with a recently constructed storm sewer project in that area and to redesign the intersection of Morse Road and Tamarack Boulevard to accommodate changes in development plans at that site.

 

This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.

 

ms consultants, inc. CC #34-6546916 (expiring 7/29/08), was selected in accordance with Chapter 329 for professional service contracts. 

 

We have negotiated new hourly rates for this modification because the current contract is 6 years old. The overhead rate and percentage of profit from the original contract were used because they are still valid.

 

The original contract amount was $965,000.00.  The total of all prior modifications is $2,605,995.45.  The total of this Modification No. 3 is $162,803.24.  The contract amount, including all modifications is $3,710,996.71.

 

Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule for construction and preserve the safety and welfare of the public.

 

Fiscal Impact:  Funds in the amount of $162,803.24 are available within the Voted 1995, 1999, 2004 Streets and Highways Fund due to encumbrance cancellations of completed projects for the Transportation Division.

Body

 

WHEREAS, contract EA031203 was authorized by Ordinance No. 1193-2001 passed July 9, 2001, executed July 20, 2001, and approved by the City Attorney on July 25, 2001; and

 

WHEREAS, it is necessary to modify this contract to modify right-of-way plans to accommodate changes required by right-of-way negotiations, to redesign the sewer at the corner of Cleveland Avenue at Morse Road to coordinate with a recently constructed storm sewer project in that area and to redesign the intersection of Morse Road and Tamarack Boulevard to accommodate changes in development plans at that site per the consultant's letter dated August 14, 2007 for the Morse Road  project; and

 

WHEREAS, it is necessary to amend the 2007 Capital Improvement Budget; and

 

WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that this contract should be modified and increased  immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the 2007 Capital Improvements Budget established within ordinance 0733-2007 be and hereby is amended due to encumbrance cancellations as follows:

SECTION 4.  That for the purpose of paying the cost thereof, the sum of $162,803.24 or so much thereof as may be needed, is hereby authorized to be expended from the 1995, 1999, 2004 Voted Street and Highway Fund for the Transportation Division, Dept/Div. 59-09, OCA code 644385, O.L 01/03 Codes 06/6682, and project number 530052.

 

SECTION 5.  That the Public Service Director be and is hereby authorized to modify and increase contract EA031203, with ms consultants, inc. to complete the design, construction plans and permits for the Morse Road project.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
