Explanation
 
Background:  The Division of Sewerage and Drainage has an existing contract with Evans, Mechwart, Hambleton & Tilton, Inc. for the design of the Group 8A Areawide Stormwater System Improvements.  A portion of this overall stormwater improvement is the design of a new stormwater system for Joyce Avenue and Hudson Street.
 
The Transportation Division has identified Joyce Avenue and Hudson Street as streets that are in need of full reconstruction.  This area is included in the Operation  Safewalks program, therefore curbs and sidewalks will also be provided with the street reconstruction.
 
Both projects are in the same location therefore it would be in the best interest of the public to construct both projects simultaneously.  This legislation authorizes the Director of Public Utilities to enter into a modification to the design contract XC820031 with Evans, Mechwart, Hambleton & Tilton, Inc. for the Group 8A Areawide Stormwater System.  
 
The contract modification is needed to produce roadway construction drawings to reconstruct Hudson Street from approximately Cleveland Avenue to approximately Parkwood Avenue; and Joyce Avenue from Hudson Avenue to Kenmore Road.  The work to modify the design is projected to begin in February 2008.  Construction is scheduled for the construction season of 2008.  The cost of the street reconstruction work is estimated to be $3,500,000.
 
This modification is an addition to the original scope of service but is a continuation of the existing work already performed and it would be more expensive and time consuming to contract with a different consultant.   It is appropriate and cost efficient for both types of projects to be in construction at the same time.  
 
The total amount of this modification is $400,000.00.  The original contract amount was $551,658.68.  The total amount of the contract, including all modifications, is $1,227,813.38.
 
EMH&T's contract compliance number is 31-0685594 and it expires 11/2/09.
 
Fiscal Impact:  Funding for this project is budgeted and available in the 2007 Capital Improvement Budget within the Voted 1995, 1999, 2004 Streets and Highways Fund.   
 
Emergency Justification:  Emergency action is requested to keep this project on schedule.  The storm water project was under design when the Mayor announced the Operation Safewalks program and the Transportation Division identified Joyce Avenue and Hudson Street as a candidate project.  It is appropriate and cost efficient to have both types of work under construction at the same time.  The Department of Sewerage and Drainage has the storm water project budgeted for construction in 2008.  Emergency legislation will allow the design consultant to begin work on the additional work items by February 2008 and Department of Sewerage and Drainage will be able to sell the project in the construction season of 2008.

WHEREAS, Contract No. XC820031 was authorized by Ordinance No. 2968-98, for the Group 8A Areawide Stormwater System Improvements - CIP 704;  Linden Ditch Areawide Storm System Improvements; and final design for Joyce Avenue, Hudson Street, and Areawide Stormwater Improvements; and Modification No. 1 was authorized by Ordinance No. 290-03, passed February 24, 2003; Modification No.2 was authorized by Ordinance No. 0748-2006, passed April 24, 2006; all through the Division of Sewerage and Drainage, and
 
WHEREAS, it is necessary to modify this Contract No. XC820031 to increase the scope of service to provide for contract construction drawings to reconstruct Hudson Street from approximately Cleveland Avenue to approximately Parkwood Avenue; and Joyce Avenue from Hudson Avenue to Kenmore Road, and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Utilities Department, Division of Sewerage and Drainage, in that it is immediately necessary to authorize the modification of this agreement with the consultant as soon as possible in order allow the design consultant to begin work on the additional work items by February 2008, thereby preserving the public health, peace, property, safety and welfare, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2007 Capital Improvements Budget established within ordinance 0733-2007 be and hereby is amended as follows:

SECTION 2.  That the City Auditor be and hereby is authorized to transfer $400,000.00 within Fund 704, the Voted 1995, 1999, 2004 Streets and Highways Fund, Department No. 59-09, Transportation Division, as follows:

SECTION 3.  That for the purpose of paying the cost thereof, the sum of $400,000.00 or so much thereof as may be needed, is hereby authorized to be expended from the Voted 1995, 1999, 2004 Streets and Highways Fund for the Transportation Division, Dept/Div. 59-09, OCA code 644385, O.L 01/03 Codes 06/6682, and project number 590955.
 
SECTION 4.  That the Public Utilities Director be and is hereby authorized to modify and increase Contract No. XC820031 with Evans, Mechwart, Hambleton & Tilton, Inc. at 5500 New Albany Road, Columbus, Ohio 43054 in an amount not to exceed $400,000.00 to provide for the additional work necessary to provide for contract construction drawings to reconstruct Hudson Street from approximately Cleveland Avenue to approximately Parkwood Avenue; and Joyce Avenue from Hudson Avenue to Kenmore Road.
 
SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
