Explanation
 
BACKGROUND:  The City of Columbus Department of Finance and Management, Facilities Management Division, needs to modify the contract with Kone, Inc. for the installation of new elevator computer equipment in the Municipal Court building.  The current elevator computer equipment was installed in 2000 and is currently in a state of disrepair.  Only one of the four computers currently work and it has no visual monitor support.  These problems were not foreseen in awarding the original contract to Kone, Inc.  The new elevator computer equipment will be used to control the elevator services within the building. The computers will assist in maintaining security parameters to the floors, and to lock and unlock elevators for night cleaning, mediation meetings, and mock trials. The computers will also show elevator breakdowns and provide maintenance and security with the ability to run the cars to all floors and answer all calls to all of the floors.
 
Due to the elevator contract and its responsibilities per the service and maintenance agreement, Kone, Inc. is the elevator provider and is responsible for the operation of equipment in the building. The operations include the computer equipment.  Therefore, it would not be in the best interests of the City to bid this equipment.  Awarding it to another elevator provider could cause a conflict with the current provider's ability to maintain the equipment.  The price of this work was negotiated between the City and Kone, Inc. based on current market prices.
Emergency action is requested so that there is no break in the delivery of maintenance or service to the Municipal Court building elevators, thereby providing necessary safety services to employees and citizens who use the Municipal Court building.

Fiscal Impact:  The total cost of the contract modification authorized by this ordinance is $17,436.00.  These funds are available in the Construction Managment Capital Improvment Fund.  The cost of the original renewal contract, authorized by Ordinance No. 1127-2007, passed July 19, 2007, was $168,000.00.  Therefore, the total 2007 cost for this contract is $185,436.00.  Costs in 2006 were $169,104.00 and in 2005 they were $153,000.00.

WHEREAS, the Facilities Management Division has a need to modify a contract for the installation of new elevator computer equipment from Kone, Inc. for the purpose of establishing and maintaining the control of elevator services in the Municipal Court building, and
 
WHEREAS, the Facilities Management Division negotiated a price with Kone, Inc. in accordance with the contract modifications provisions of the Columbus City Codes, and
 
WHEREAS, an emergency exists in the usual daily operation of the Facilities Management Division in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Kone, Inc. for the installation of new elevator computer equipment, in order to preserve the safety elevator services provided to the employees and the citizens that use the Municipal Court building, thereby preserving the public property, health, safety and welfare; now therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:  
 
SECTION 1.  That the Finance and Management Director is hereby authorized to modify a contract, on behalf of the Facilities Management Division, with Kone, Inc., for the installation of new elevator computer equipment.
 
SECTION 2.   That the expenditure of $17,436.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.
