Title: To accept various deeds for parcels of real property acquired by the City through the street plan development process for use as sidewalk, traffic signal and/or street drainage purposes.

Explanation

 

From time to time during the street plan development process for non Capital Improvement Projects the need for additional real property is identified by the Transportation Division.  This additional property is usually acquired by the City in the form of easements for sidewalk, traffic signal, and/or street drainage purposes.  The following legislation provides for the City to accept various deeds for parcels of real property acquired by the City as a result of the street plan development process.

 

Title

 

To accept various deeds for parcels of real property acquired by the City through the street plan development process for use as sidewalk, traffic signal and/or street drainage purposes.

 

Body

 

WHEREAS, from time to time during the street plan development process for non Capital Improvement Projects the need for additional real property is identified by the Transportation Division; and

 

WHEREAS, this additional property is usually acquired by the City in the form of easements for sidewalk, traffic signal, and/or street drainage purposes; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200409100212405, Walcutt Columbus, LLC has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Walcutt Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200506200118983, Third Glen, Inc., has deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of a ditch, channel, water course or other drainage facility and appurtenances thereto in the Emrick Road area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200512050254587, Michael A. Ornstein and Marcus S. Ornstein have deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of sewer utility lines and appurtenances thereto in the East Broad Street area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200512050254589, Michael A. Ornstein and Marcus S. Ornstein have deeded a perpetual general utility easement to the City of Columbus, for the purposes of constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of utilities and appurtenances thereto in the Reynolds Crossing Drive area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200605150092784, Abbott Laboratories, has deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Stelzer Road and Montclair Drive area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200606090112489, Traditions at Highbluffs, LLC has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200606090112490, Traditions at Highbluffs, LLC has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200608040153558, Blendon-Beecham Properties has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Dublin-Granville Road (S.R. 161); and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200608040153560, Plaza GRB Hamilton Road, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Hamilton Road at Hamilton Square Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200608040153566, Plaza GRB Hamilton Road, LLC, has deeded a perpetual general utility easement to the City of Columbus, for the purposes of constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of utilities and appurtenances thereto along a portion of Hamilton Road at Hamilton Square Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200610100201586, Michael D. Smith and Sarah D. Smith have deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Broadview Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200610260214949, Portrait Homes-Bedford Place, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of East Broad Street; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200610260214951, National City Bank, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of New Albany Road West; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200610260214952, JP Morgan Chase Bank, NA, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of New Albany Road West; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200610260214953, The New Albany Company, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of New Albany Road West; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200611160229206, Olentangy Highbluffs Association, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200611160229210, the Board of Education of the Columbus City School District, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Hamilton Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200612140247973, Sawmill Partners Investment Company No. II, has deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Sawmill Road and Summer Drive area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200612140247975, Sawmill Hard Center LLC, has deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Sawmill Road and Summer Drive area; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200701120007449, Franklin County Commissioners, have deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating utilities and sidewalks and appurtenances thereto along a portion of Children's Drive West; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200701120007450, Worthington Loop Investments, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Worthington Woods Loop Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200701120007451, Wishbone Partners, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic signs, signals, detectors, control devices and appurtenances thereto along a portion of New Albany Road West; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200703020036206, WH Capital, LLC, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Gender Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200703020036209, the Board of Education of the Columbus City School District, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Stratford Way; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200703020036211, Tim Donut U.S. Limited, Inc, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of an existing service road west of North Meadows Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200703020036213, Dominion Homes, Inc, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Courtright Road at Boston Commons Place and Courtright Road at Soldier Street; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200705160085280, the Board of Education of the Columbus City School District, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of Engler Street; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200706270111703, PEDC Property Management, Inc., has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Walcutt Road; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200708160145130, Tanglewood Park, LLC, Roth Tanglewood, LLC and Luckoff Land Company, LLC, have deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Tanglewood Park Boulevard; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Franklin County, Ohio, Recorder's Office, as Instrument Number 200709140162397, the Board of Education of the Columbus City School District, has deeded property to the City of Columbus, to be used for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Sycamore Street; and

 

WHEREAS, by virtue of a DEED OF EASEMENT recorded in the Delaware County, Ohio, Recorder's Office, on June 25, 2004 in Deed Book Volume 0518, Page 2446, N.P. Limited Partnership, has deeded property to the City of Columbus, to be used for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Polaris Parkway area; and

 

WHEREAS, the City desires to accept these deeds; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200409100212405, a DEED OF EASEMENT from Walcutt Columbus, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Walcutt Road.

 

Section 2.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200506200118983, a DEED OF EASEMENT from Third Glen, Inc., for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of a ditch, channel, water course or other drainage facility and appurtenances thereto in the Emrick Road area.

 

Section 3.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200512050254587, a DEED OF EASEMENT from Michael A. Ornstein and Marcus S. Ornstein, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of sewer utility lines and appurtenances thereto in the East Broad Street area.

 

Section 4.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200512050254589, a DEED OF EASEMENT from Michael A. Ornstein and Marcus S. Ornstein, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of utilities and appurtenances thereto in the Reynolds Crossing Drive area.

 

Section 5.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200605150092784, a DEED OF EASEMENT from Abbott Laboratories, for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Stelzer Road and Montclair Drive area.

 

Section 6.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200606090112489, a DEED OF EASEMENT from Traditions at Highbluffs, LLC, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard.

 

Section 7.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200606090112490, a DEED OF EASEMENT from Traditions at Highbluffs, LLC, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard.

 

Section 8.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200608040153558, a DEED OF EASEMENT from Blendon-Beecham Properties, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Dublin-Granville Road (S.R. 161).

 

Section 9.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200608040153560, a DEED OF EASEMENT from Plaza GRB Hamilton Road, LLC, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Hamilton Road at Hamilton Square Boulevard.

 

Section 10.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200608040153566, a DEED OF EASEMENT from Plaza GRB Hamilton Road, LLC, for constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of utilities and appurtenances thereto along a portion of Hamilton Road at Hamilton Square Boulevard.

 

Section 11.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200610100201586, a DEED OF EASEMENT from Michael D. Smith and Sarah D. Smith, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Broadview Road.

 

Section 12.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200610260214949, a DEED OF EASEMENT from Portrait Homes-Bedford Place, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of East Broad Street.

 

Section 13.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200610260214951, a DEED OF EASEMENT from National City Bank, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of New Albany Road West.

 

Section 14.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200610260214952 a DEED OF EASEMENT from JP Morgan Chase Bank, NA, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of New Albany Road West.

 

Section 15.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200610260214953, a DEED OF EASEMENT from The New Albany Company, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of New Albany Road West.

 

Section 16.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200611160229206, a DEED OF EASEMENT from Olentangy Highbluffs Association, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Highbluffs Boulevard.

 

Section 17.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200611160229210, a DEED OF EASEMENT from the Board of Education of the Columbus City School District, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Hamilton Road.

 

Section 18.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200612140247973, a DEED OF EASEMENT from Sawmill Partners Investment Company No. II, for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Sawmill Road and Summer Drive area.

 

Section 19.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200612140247975, a DEED OF EASEMENT from Sawmill Hard Center LLC, for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Sawmill Road and Summer Drive area.

 

Section 20.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200701120007449, a DEED OF EASEMENT from Franklin County Commissioners, for the constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating utilities and sidewalks and appurtenances thereto along a portion of Children's Drive West.

 

Section 21.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200701120007450, a DEED OF EASEMENT from Worthington Loop Investments, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Worthington Woods Loop Road.

 

Section 22.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200701120007451, a DEED OF EASEMENT from Wishbone Partners, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic signs, signals, detectors, control devices and appurtenances thereto along a portion of New Albany Road West.

 

Section 23.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200703020036206, a DEED OF EASEMENT from WH Capital, LLC, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Gender Road.

 

Section 24.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200703020036209, a DEED OF EASEMENT from the Board of Education of the Columbus City School District, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Stratford Way.

Section 27.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200705160085280, a DEED OF EASEMENT the Board of Education of the Columbus City School District for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along portions of Engler Street.

 

Section 28.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200706270111703, a DEED OF EASEMENT from PEDC Property Management, Inc for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Walcutt Road.

 

Section 29.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200708160145130, a DEED OF EASEMENT from Tanglewood Park, LLC, Roth Tanglewood, LLC and Luckoff Land Company, LLC for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Tanglewood Park Boulevard.

 

Section 30.  That the City of Columbus hereby accepts the property more fully described in Instrument Number 200709140162397, a DEED OF EASEMENT from the Board of Education of the Columbus City School District, for the constructing, installing, reconstructing, replacing, removing, repairing, maintenance and operation of pedestrian walkway/sidewalk and appurtenances thereto along a portion of Sycamore Street.

 

Section 31.  That the City of Columbus hereby accepts the property more fully described in the DEED OF EASEMENT recorded in the Delaware County, Ohio, Recorder's Office in Deed Book Volume 0518, Page 2446 from N.P. Limited Partnership, for constructing, installing, reconstructing, replacing, removing, repairing, maintaining and operating traffic pavement markers, signs, signals, detectors, control devices and appurtenances thereto in the Polaris Parkway area.

 

Section 32.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
