Title: To authorize the Director of Finance and Management to request, by both public notice and real estate industry notice, proposals and offers for the purchase of approximately 2.447 acres of City-owned real property located at the southeast corner of Vine Street and Neil Avenue; entertain discussion from and enter into negotiations with interested parties with respect to the purchase; to waive the land review commission requirements of Columbus City Codes (1959) Revised; and to declare an emergency.

Explanation

 

The City currently owns certain property at the southeast corner of Vine Street and Neil Avenue comprised of 2.447 acre of vacant land.  The City originally acquired the land in January 2000 as part of the Vine Street Extension Project. The City has received inquiries from private parties regarding the availability of the site for purchase in order for the parties to develop the property for a commercial use.  The site is not identified for use in future City operations and is identified as surplus property. In order to determine what course of action is in the best interest of the City regarding the property, the Director of the Department of Finance and Management requests authority to determine the current marketability of the property by soliciting proposals and offers for the purchase of the property, by both public notice and real estate industry notice, and to entertain discussions and negotiations with interested parties with respect to the sale of the property. The following legislation authorizes the Director of the Department of Finance and Management to advertise the property, solicit purchase proposals, respond to and negotiate with interested parties, waive the land review commission requirements of Chapter 328 and Chapter 329 of the Columbus City Codes (1959) Revised, and declare an emergency.

Emergency Justification: Emergency action is requested to allow the City to immediately begin the process to determine the current marketability of the property in order to determine the what course of action is in the best interest of the City.

Body

 

WHEREAS,  the City of Columbus owns approximately 2.447 acresof vacant land at Vine Street and Neil avenue; and

 

WHEREAS,  the City has received inquiries from private parties interested in redeveloping the site for commercial use and requests authority to determine the current marketability of the site in order to determine what course of action is in the best interest of the City; and

 

WHEREAS,  any agreement for sale of the property shall require approval by Council ordinance; and

 

WHEREAS,  an emergency exists in the usual daily operation of the City, in that it is necessary to immediately authorize the Director of the Department of Finance and Management to determine the current marketability of the property, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore:

 

BE  IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

 

Section 1.  That the Director of the Department of Finance and Management be authorized to solicit proposals and enter into negotiations regarding the potential sale of aproximately 2.447 acres of real property.

 

Section 2. That this Council has detemined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328 (land review commission) and that portion of Chapter 329 that pertains to land review commission requirements.

 

Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
