Explanation
 
Background:  The Purchasing Division solicited bids for one (1) skid steer loader unit with three (3) optional attachments.  Five bids were received and opened by the Purchasing Division on November 15, 2007.  Bids are as follows:

This ordinance will enable the Director of Finance and Management to purchase one (1) skid steer loader unit with three attachments in accordance with the terms and conditions of formal bid SA002698.  The loader and equipment are used in the daily operations of the Forestry Tree Nursery.  The loader is a replacement of similar type of equipment.  The attachments consist of one (1) tree shovel, one (1) snow blade and one (1) loader boom and are all functional units that fit the New Holland Model L180 which is designed for specific tasks performed by Forestry Division personnel.  Additionally, the equipment will be used to assist with snow removal at City locations as well as assist other departments with snow emergency operations.
 
The Federal Identification Number for Franklin Tractor Sales, Inc. is 31-0678261.  Contract compliance expires 08/05/08.
 
This ordinance is submitted as an emergency in order to take delivery of the equipment in early 2008 for the beginning of the spring tree planting season.
 
Fiscal Impact:  Funding for the skid steer loader with attachments in the amount of $32,763.00 will come from the Voted Recreation and Parks Bond Fund:  Dept. 51; Fund 702; OCA Code 510040; Project 510040; Object Level 6651 and is contingent on 2007 bond fund proceeds.

To authorize the Director of Finance and Management to enter into contract with Franklin Tractor Sales, Inc. for the purchase of one (1) skid steer loader unit with attachments in accordance with the competitive bidding procedures of the Columbus City Code, to authorize the expenditure of $32,763.00 from the Voted Recreation and Parks Bond Fund, and to declare an emergency.  ($32,763.00)
 
Body
 
WHEREAS, this equipment is used in the daily operations of the Forestry Tree Nursery to maintain nursery tree stock and plant trees to assist in meeting the goals of the Mayor's Green Initiative; and
 
WHEREAS, this equipment is used to assist with snow removal tasks at various City locations and in the event of unforeseen snow emergencies; and
      
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with Franklin Tractor Sales, Inc. so that the equipment can be received in time for the spring tree planting season; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Finance and Management be and he is hereby authorized and directed to enter into a purchase order with Franklin Tractor Sales, Inc. for the purchase of one (1) skid steer loader with attachments for the Forestry Division of the Recreation and Parks Department, in accordance with the terms and conditions of Contract Number SA002698.
 
SECTION 2.   That the expenditure of $32,763.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted Recreation and Parks Bond Fund as follows, to pay the cost thereof:

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 4.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
