Explanation
1. BACKGROUND:
This legislation authorizes a modification to the engineering contract with American Structurepoint, Inc., formally known as American Consulting, Inc., for design services for sidewalks along Marion Road between Parsons Avenue and Lockbourne Road. The Transportation Division determined that construction of sidewalks along Marion Road were to be a part of the Operation Safewalks Initiative. Marion Road is uncurbed therefore the storm improvements and sidewalks will be constructed adjacent to each other outside the roadway. The storm improvements and sidewalks are interdependent requiring them to be designed at the same time.
2. FISCAL IMPACT:
There is sufficient cash and authority in the proper account for this project. This is a joint contract with the Transportation Division. The original contract was setup for the Stormwater portion only. The additional expenses for the design of the sidewalks are being paid by the Transportation Division.

To amend the 2007 C.I.B; to authorize the City Auditor to transfer funds within the Voted 1995,1999, 2004 Streets and Highways Fund; to authorize the Director of Public Utilities to execute a professional engineering services agreement modification with American Structurepoint, Inc. for design services for sidewalks along Marion Road between Parsons Avenue and Lockbourne Road; and to authorize the expenditure of $59,419.00 from the Voted 1995,1999, 2004 Streets and Highways Fund for the Sewerage and Drainage Division and Transportation Division. WHEREAS, Contract No. EL006694 was authorized by Ordinance No. 1841-2006, passed November 20, 2006; was executed January 10, 2007; and was approved by the City Attorney on January 23, 2007; and
WHEREAS, the Division of Sewerage and Drainage and Transportation Division engineering personnel have determined it to be in the best interest of the City of Columbus to increase the contract amount to incorporate these engineering services for this project with American Structurepoint, Inc. through the existing contract; and
WHEREAS, it is necessary for the City Council to authorize the expenditure of funds from the Voted 1995, 1999, 2004 Streets and Highways Fund; and
WHEREAS, It is therefore necessary for the Divisions of Sewerage and Drainage and Transportation, Departments of Public Utilities and Public Service, to request this City Council to authorize the Director of Public Utilities to modify the subject contract for purposes of engineering services for the design of sidewalks along Marion Road between Parsons Avenue and Lockbourne Road and to allow for the increased cost of said services, at the earliest practicable date, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 2. That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
Section 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
Section 4. That the Director of Public Utilities be, and hereby is, authorized to execute an agreement with American Structurepoint, Inc., 2550 Corporate Exchange Drive, Suite 300, Columbus, Ohio 43231 for the Division of Sewerage and Drainage, for professional engineering services modification in accordance with the terms and conditions on file in the office of the Division of Sewerage and Drainage.
Section 5. That the said engineering firm shall conduct the work to the satisfaction of the Directors of Public Utilities and Public Service and the Administrators of the Division of Sewerage and Drainage and Transportation.
Section 6. That the 2007 Capital Improvements Budget established within ordinance 0733-2007 be and hereby is amended to provide funding for this contract modification as follows:

Section 7. That the City Auditor be and hereby is authorized to transfer $59,419.00 within Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, as follows:

Section 8. Section 9. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
