EXPLANATION
 
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to execute a planned contract modification with ME Companies, Inc. to the Division of Sewerage and Drainage's general engineering services contract.  This modification will increase the funding for the contract services by an additional $200,000.00 ($100,000 for Sanitary and $100,000 for Storm).  This award will modify a previous engineering services contract to augment existing engineering personnel within the Sewer System Engineering Section  (SSES) of the Division of Sewerage and Drainage on an as-authorized, as needed basis.
 
2.  CONTRACT MODIFICATION INFORMATION:
This contract was originally procured for purposes of providing engineering services to augment engineering personnel within the Sewer System Engineering Section (SSES) of the Division of Sewerage and Drainage on an as-authorized, as needed basis.  The contract was established with fixed direct labor, overhead, and fixed fee rates for the period of 2006 through 2009.  This ordinance will authorize the establishment of $200,000.00 in additional funding split evenly between the two aforementioned divisions of SSES.  Under the terms of this contract, the City has the right to contract for additional services to fulfill emergency capital improvements or smaller scoped projects, subject to the approval of a contract modification by City Council to provide general engineering services for the Division of Sewerage and Drainage.  The rates established within this contract will remain in force throughout the life of the contract.
 
3.  FISCAL IMPACT:
This legislation includes a transfer of funds within the Sanitary Sewer Revenue Bonds Fund and an amendment to the 2007 Capital Improvements Budget to allow sufficient cash and authority in the proper account for this project.  There is already sufficient funding for the necessary expenditure in the Storm Sewer Bond Fund.

WHEREAS, Ordinance No. 1568-2007, as passed October 16, 2006, authorized the Director of Public Utilities to enter into a professional engineering services contract with ME Companies, Inc., for general engineering services; and
 
WHEREAS,  Ordinance No. 1119-2007, as passed July 30, 2007, authorized the Director of Public Utilities to modify the existing professional engineering services contract with ME Companies, Inc., to supply necessary additional general engineering services funds, and
 
WHEREAS, it is necessary to modify the subject contract in order to provide funding for the ongoing and immediate demand for additional professional engineering, survey, and technical services in order to replace, rehabilitate, or expand existing sanitary, storm, and combined sewer infrastructure under both emergency and expedited circumstances; and      
 
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it to be in the best interest of the City of Columbus to increase the contract amount to obtain additional general engineering services with ME Companies, Inc., through the existing contract; and
 
WHEREAS, it is necessary for Council to authorize the City Auditor to transfer funds within the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient budget authority for the project expenditure; and
 
WHEREAS, it is necessary for Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund and from the Storm Sewer Bond Fund; and
 
WHEREAS, it is necessary for this City Council to authorize the Director of Public Utilities to modify the existing contract with ME Companies, Inc, for the additional general engineering services required for the proper maintenance and rehabilitation of its sanitary, storm, and combined sewer infrastructure, at the earliest practicable date, Now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
      
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to enter into a professional engineering services contract with ME Companies, Inc., 635 Brooksedge Boulevard, Westerville, Ohio 43081, that will provide general engineering design services in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Sewer System Engineering Section.
 
Section 2.  That the said engineering firm shall conduct the work to the satisfaction of the Director of Public Utilities, the Administrator of the Division of Sewerage and Drainage, and the Division of Sewerage and Drainage's Sewer System Engineering Manager.
 
Section 3.  That the City Auditor be and hereby is authorized and directed to transfer a total of $50,000 from within the Sanitary Sewer Revenue Bonds Fund No. 665 | Division 60-05 | Object Level Three 6676:

Section 4.  That the 2007 Capital Improvements budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the project expenditure stated in the ordinance herein.

Section 8.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 9.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
Section 10.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
