Explanation
 
BACKGROUND:  This Ordinance authorizes the Public Utilities Director to modify and increase a professional engineering services contract with MS Consultants, Inc., to allow for the design of a section of water main that was not in the original Morse Road 36" Water Main Contract, Division of Power and Water Contract Number 1059, in the amount of $41,000.00.  
 
MS Consultants, Inc. has already done extensive design for this section of water main through a contract with the City of Gahanna.  Initially, Gahanna had agreed to maintain the engineering contract with MS Consultants, Inc even though the project did not provide a direct benefit to their water system.  The plans and specifications were prepared using Gahanna's standards.  The project was then delayed several years due to easement acquisition.   Because of the delays and financial impacts, Gahanna prefers to no longer maintain the contract.   Additionally, the construction permits expired.  
 
The contract modification will allow the Division to revise the construction drawings and specifications to reflect the City of Columbus as the owner; allow for the required construction permits to be submitted and obtained from the various regulatory agencies; and allow for the construction drawings to be updated to current industry standards.  Ultimately this will allow the City to solicit bids and construct the project.  
 
The project is critical for the Division of Power and Water as it will be a direct supply to the Taylor Road Water Storage Tank (currently under construction) which will need to be placed in service to support customers on the far East side.  A modification is also necessary because the Franklin County Engineer's Office is in design of a round-about at Reynoldsburg-New Albany Road which will be in conflict with this project.  Franklin County's project is expected to begin construction in Spring of 2009.  Construction must be completed in this area prior to Franklin County's project being started.

Original Contract Amount:      $171,000.00      
Original contract + modification #1 (current):      $212,000.00
 
2.  Reasons additional goods/services could not be foreseen:

3.  Reason other procurement processes are not used:  
It would not be feasible to contract with another consultant since MS Consultants, Inc. has already done extensive design through a contract with the City of Gahanna.  
 
4.  How cost of modification was determined:
The Division of Power received a proposal from the consultant and was deemed acceptable based on the scope of services provided.

WHEREAS, Contract No. EL006465 was authorized by Ordinance No. 1174-2006, passed July 24, 2006; executed October 2, 2006; and approved by the City Attorney on October 6, 2006; and
 
WHEREAS, a modification and increase to the Morse Road 36" Water Main contract is needed to allow construction drawings and specifications to be revised and updated to current City of Columbus standards and to allow for the appropriate construction permits to be submitted and obtained; and
 
WHEREAS, it is necessary to modify Contract No. EL006465 to authorize the funds required to allow payment to MS Consultants, Inc. for the revision and update of construction drawings and specifications to the Morse Road 36" Water Main contract; and
 
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Power and Water, to authorize the Director of Public Utilities to modify and increase the professional engineering services contract with MS Consultants, Inc., for the Morse Road 36" Water Main Contract, for the preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Utilities Director is hereby authorized and directed to modify and increase the professional engineering services contract with MS Consultants, Inc., for the Morse Road 36" Water Main Contract, in the amount of $41,000.00.
SECTION 2.  That this contract modification is in compliance with Section 329.13 of Columbus City Codes, 1959.
 
SECTION 3.  That for the purpose of paying the cost of the contract modification, the sum of $41,000.00 or so much thereof as may be necessary be and hereby is authorized to be expended as follows:  Division of Power and Water (Water), Dept./Div. No. 60-09, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Project 690474, OCA Code 606474, Object Level One 06, Object Level Three 6629, Amount $41,000.00.
 
SECTION 4.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 7.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
