Explanation
 
Background:   This legislation authorizes the Public Service Director to enter into contract for the Transportation Division for four professional services engineering contracts for General Engineering.   The intent of these projects is to provide the City of Columbus, Transportation Division, additional resources to perform various engineering and surveying tasks specifically for the Production and Planning sections. There will be four General Engineering contracts.
 
In order to provide more opportunities for small and emerging businesses, four separate contracts bid at the same time have been solicited.  However, no qualified business was exempted.  In addition, since these contracts may be used for quick response design services, it is better management practice to have four separate contracts with each contract having a separate manager than to have one or two larger contracts with multiple managers.  The consultant will receive direction from one individual, thereby limiting miscommunication.  The consultant will have fewer tasks, fewer problems regarding priorities, and increased ability to complete a given task on schedule.
 
The projects developed under this program are typically small to moderate size improvements, and frequently include a significant emphasis on pavement rehabilitation, curb replacement, sidewalks, curb ramps, drainage, minor rehabilitations, and aesthetic improvements.  These contracts may be used for quick response design services.  The selected consultants will perform such tasks when requested by the City.  The timeframe for these contracts will be two years.
 
The contracts will be written for $250,000.00 each to the following companies:  
 
ME Companies (Majority, CC#:  31-1442777, Expiration Date:  1/23/2010)
Resource International (FBE, CC#: 31-0669793, Expiration Date: 7/29/08)
American Structurepoint (Majority, CC#: 351127317, Expiration Date: 12/11/09)
Prime Engineering (FBE, CC#: 31-1373357, Expiration Date: 4/8/10)
 
These professional services contracts for engineering are needed to assure timely completion of the designs and as the Transportation Division does not maintain adequate staff or all of the various engineering disciplines necessary to complete such designs in house.
 
The selection process for these professional services contracts were completed in accordance with provisions of Chapter 329 of the Columbus City Codes, 1959.   
 
Emergency Action is requested so that these projects can proceed in a timely manner and keep commitments made to the local community.  The Transportation Division has existing design tasks that would be desirable to assign to the consultants in association with projects that will be constructed in 2008.  Therefore, emergency action is requested for the earliest use of this contract.
 
Fiscal Impact:   The sum of $1,000,000.00 is budgeted and available within the 2007 Capital Improvements Budget for this project.

Body
 
WHEREAS, there is a need to provide professional engineering design services in support of the Capital Improvement program; and
WHEREAS, the Transportation Division received and evaluated proposals in accordance with the provisions of Section 329 of the Columbus City Codes, 1959; and
WHEREAS,  ME Companies,  Resource International,  American Structurepoint, and Prime Engineering submitted the best overall proposals for these projects; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contracts should go forth immediately so that the work may proceed without delay in order to complete design so that construction can begin in 2008, thereby preserving the public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the 2008 Capital Improvements Budget established within ordinance 0690-2008 be and hereby is amended to provide funding for this contract as follows:

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
