Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to issue a purchase order for the purchase of an excavator from Ohio Machinery Co. dba Ohio Cat under the terms and conditions of a State of Ohio Term Contract #STS 778515H. This excavator will be used by the Division of Power and Water (Power) personnel for digging in remote and limited access areas. Several excavators were tested and the Caterpillar Model 304C CR 3 best met the division's needs. Ohio Cat is the sole distributor in Ohio for this equipment and it is available under the terms of the aforementioned state term contract. The City of Columbus does not include this equipment on any Universal Term Contract. The funding on this legislation is based on a quote dated April 23, 2008 and is the State of Ohio contract pricing. Fleet Management has approved this purchase.
Ohio Machinery Co. dba Ohio Cat does not hold MBE or FBE status. Their contract compliance number is 340672363, expires 06/07/09.
Fiscal Impact: $75,000.00 was budgeted in the 2008 Electricity Operating Fund for this purchase. There were no similar purchases in 2006 or 2007.

($67,706.00)

WHEREAS, the Department of Public Utilities, Division of Power and Water (Power), wishes to purchase one (1) Caterpillar Model 304C CR 3 in accordance with State of Ohio Term Schedule STS 778515H; and
WHEREAS, the excavator will be used by Division of Power and Water (Power) personnel for digging in remote and limited access areas; and
WHEREAS, the City of Columbus does not include this type of equipment on any Universal Term Contract; and
WHEREAS, funding is based on a quote dated April 23, 2008 from Ohio Cat and the quoted price reflects State of Ohio contract pricing; and
WHEREAS, this purchase has been approved by Fleet Management, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to issue a purchase order, in the amount of $67,706.00, for the Division of Power and Water (Power) for the purchase of an excavator under the terms and conditions of State of Ohio Term Schedule STS 778515H.
SECTION 2. That the sum of $67,706.00, or so much thereof as may be necessary, is hereby authorized for the purchase of an excavator from Division 60-07, Fund No. 550, Electricity Operating Fund, OCA 606723, Object Level Three 6651.
SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
