Explanation

 

BACKGROUND:  This Ordinance authorizes the Director of Public Utilities to modify and increase the professional engineering services contract with Dynamix Engineering Ltd. for the Hap Cremean Water Plant Asbestos Hazard Abatement & Heating System Replacement Project, Division of Power and Water Contract No. 1047.

 

This is an unplanned modification that will provide for preparation of "as-built" record drawings of the improvements constructed with this project.  This service is typically included in engineering services contracts that provide for construction administration/ construction inspection services.  This task was inadvertently omitted from the project scope of work and therefore was not funded in the original contract.  The engineering consultant has gathered the necessary information to prepare these drawings as part of the inspection services performed under the original contract.   This proposed modification will cover the cost of preparing CAD drawing files of the information, engineering review of the CAD drawings, and printing costs to submit the information to the City.  The total amount of this modification is $10,000.00, a 3% increase in the contract amount.

 

1.  Amount of additional funds to be expended:  $10,000.00

 Original Contract Amount:  $258,905.00

Amount of Modification #1:  $74,688.19

Amount of original contract and two modifications:  $343,593.19

 

2.  Reasons additional goods/services could not be foreseen:  

This work is typically included in engineering contracts that provide for Construction Administration/Construction Inspection services.  The scope of work for these services was prepared by the design consultant and reviewed by the City project manager.  As this is the first contract for this design consultant with the Division of Power and Water, he was not aware this task should have been included in his scope of work.  The omission was not noted by the City project manager until the end of the construction project.

 

3.  Reason other procurement processes are not used: 

The contract work has been essentially complete.  The design consultant has all the necessary information to perform the task.  It would cost considerably more to have another consultant interpret the information and prepare the "as-built" record drawings.  The cost proposed by the design consultant to perform the work is reasonable and in line with what would be expected for this task.

 

4.  How cost of modification was determined:

Costs were submitted by the consultant and reviewed by the Division of Power and Water Engineering Staff and deemed

reasonable.

FISCAL IMPACT:  There is sufficient funding within the Water Works Enlargement Voted Bonds Fund.

 

 

Title

WHEREAS, Contract No. EL004762 was authorized by Ordinance No. 1651-2004, passed October 18, 2004, was executed on December 8, 2004, and was approved by the City Attorney on December 10, 2004; and

 

WHEREAS, Modification No. 1 EL007216 was authorized by Ordinance No. 0852-2007, passed July 9, 2007, was executed on August 15, 2007, and was approved by the City Attorney on August 20, 2007; and

 

WHEREAS, the contract needs to be modified a second time to provide for preparation of "as-built" record drawings of the improvements constructed on the Hap Cremean Water Plant Asbestos Hazard Abatement & Heating System Replacement Project; and

 

WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities, Division of Power and Water, to modify and increase the professional engineering services contract with Dynamix Engineering Ltd. to provide for preparation of "as-built" record drawings of the improvements constructed on the Hap Cremean Water Plant Asbestos Hazard Abatement & Heating System Replacement Project, for the preservation of the public health, peace, property, safety and welfare; now, therefore,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Public Utilities is hereby authorized and directed to modify and increase the professional engineering services contract with Dynamix Engineering Ltd. to provide for preparation of "as-built" record drawings of the improvements constructed on the Hap Cremean Water Plant Asbestos Hazard Abatement & Heating System Replacement Project, in the amount of $10,000.00.

 

SECTION 2.  That this contract modification is in compliance with Section 329.16 of Columbus City Codes, 1959.

 

SECTION 3.  That to pay the cost of the aforesaid contract modification, the expenditure of $10,000.00, or so much thereof as may be needed, is hereby authorized from the Water Works Enlargement Voted Bonds Fund, Fund No. 606, Division No. 60-09, Project 690286, OCA 642900, Object Level One 06, Object Level Three 6682.

 

SECTION 4.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.

 

SECTION 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 6. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 7.  That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
