BACKGROUND:
 
The purpose of this legislation is to authorize the Director of Public Utilities to increase the amount of the contract for Refractory and Thermal Systems Maintenance Services, FEM Project No. 1301.2, for the Division of Sewerage and Drainage. The Director of Public Utilities opened formal bids on June 20, 2007 and one bid was received. The original contract was established as a multi-year contract with incremental funding, approximately annually.
 
Purchase Order EL007400 was established for the Southerly Wastewater Treatment Plant, Jackson Pike Wastewater Treatment Plant and Treatment Engineering .in accordance with Ordinance Number 1298-2007, Passed 9-17-07. The additional funding being requested is needed to complete an emergency repair of the incinerator at the Southerly Wastewater Treatment Plant.
 
The Southerly plant utilizes two multiple hearth incinerators to burn dewatered municipal sludge.  These incinerators normally process an average of 240 wet tons of sludge per day in order for the plant to maintain its sludge inventory at an acceptable level and operate at peak efficiency.  In February 2008 the plant removed No. 3 incinerator from service because a large piece of refractory had fallen down into the incinerator.  The Adrian L. Wallick Co., holder of the Refractory and Thermal Systems Services contract, was called to perform an incinerator inspection and complete any necessary repairs in accordance with the contract.  The Adrian L. Wallick Company inspected the incinerator and exhaust ductwork where the refractory had failed.  That inspection revealed that two hearths within the incinerator required replacement and identified serious problems in the incinerators' exhaust ductwork relating to the deterioration of the outer metal shell of the ductwork.  Operating the incinerators without making the necessary repairs could result in major damage to the incinerators and associated equipment.  Failure to make the necessary repairs also places plant personnel's safety in danger due to the extremely high temperatures that can be present on the outside surface of the metal ductwork.
 
Having the plant's incinerators out of service for extended periods of time severely impacts the plant's ability to process and dispose of the required amount of sludge on a daily basis.  It is critical that the plant act immediately to complete the necessary repairs to No. 3 incinerator.  Due to the nature of this repair work, it is not possible to determine accurately what the final costs of these services and products will be.  It is estimated that a maximum cost for the necessary work/services will be $ 925,000.00. The plant's maintenance department does not have the tools, personnel, or expertise needed to complete the repairs
 
 
SUPPLIER: Adrian L. Wallick Company (31-4425505). Expires 6-11-09
 
FISCAL IMPACT: $ 925,000.00 is needed for this modification and is budgeted specifically for this type of unanticipated repair or renovation.
 
Emergency legislation is being requested so that the incinerators at the Southerly Wastewater Treatment Plant can be repaired to prevent a complete shut down of the equipment which is utilized to burn sewage sludge and is vital to the overall wastewater treatment process.

WHEREAS,  bids for Refractory and Thermal Systems Maintenance Services for the Division of Sewerage and Drainage were received by the Director of Public Utilities on June 20, 2007; and

Having the plant's incinerators out of service for extended periods of time severely impacts the plant's ability to process and dispose of the required amount of sludge on a daily basis, and
 
WHEREAS, The plant's maintenance department does not have the tools, personnel, or expertise needed to complete the repairs, and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, in that it is immediately necessary to increase the contract for Refractory and Thermal Systems Maintenance Services so that the incinerators at the Southerly Wastewater Treatment Plant can be repaired to prevent a complete shut down of the equipment which is utilized to burn sewage sludge and is vital to the overall wastewater treatment process, with Adrian L. Wallick Company for the immediate preservation of the public health, peace, property and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Utilities be, and hereby is, authorized to increase the contract with Adrian L. Wallick Company, 1013 Gahanna Parkway, Columbus OH 43230, for Refractory and Thermal Systems Maintenance Services for the Division of Sewerage and Drainage, in accordance with the terms and conditions as shown in the contract on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That the expenditure of $925,000.00, or as much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund 650, Department 60-05, to pay the cost of this contract, as follows: OCA: 604793, Object Level 3374.
 
Section 3.  That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
