Explanation
 
Background:
 
This ordinance will enable the Director of Public Utilities to reimburse the Franklin County Engineer for electricity infrastructure improvements included in the Greenlawn Bridge over Scioto River Project.
 
The Franklin County Engineer, under the direction of the Department of Public Utilities, authorized additional construction services to the Greenlawn Avenue Bridge over the Scioto River Project.  Improvements completed for the Department of Public Utilities included construction of a duct bank in the sidewalk spanning the bridge, installation of approximately 1200 Linear Feet of  15,000 Volt underground cable, 2 riser poles, 2 manholes, necessary splices, connectors and other incidentals to complete the work.
 
The Contract Compliance Number for the Franklin County Engineer is #31-6400067/044.
 
Emergency legislation is necessary as Franklin County has already paid the contractor for this work.
Fiscal Impact:
 
This legislation includes a transfer of funds within the Voted Street Lighting and Electricity Distribution Improvements Fund and an amendment to the 2008 Capital Improvements Budget.  $42,415.47 is required to meet the financial obligation of this reimbursement agreement.

Body
 
WHEREAS, the Franklin County Engineer authorized additional construction services for electricity infrastructure improvements on the Greenlawn Avenue Bridge Project at the request of the Department of Public Utilities; and
 
WHEREAS, it is necessary to reimburse Franklin County for improvements made at the Department of Public Utilities' request; and
 
WHEREAS, it is necessary to authorize an amendment to the 2008 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditures; and
 
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Voted Street Lighting and Electricity Distribution Improvements Fund; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to reimburse said expenditures for the preservation of public health, peace, property and safety as the county has already paid the contractor for this work; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Public Utilities is hereby authorized and directed to reimburse the Franklin County Engineer for electricity improvements on the Greenlawn Avenue Over Scioto River Bridge Project, in accordance with requested changes from the Department of Public Utilities in the amount of $42,415.47.
SECTION 2.  The Franklin County Engineer and its contractors shall conduct the work to the satisfaction of the Director of Public Utilities and the Administrator of the Division of Power and Water.
 
SECTION 3.  That the City Auditor is hereby authorized to transfer $2,416 within the Division of Power and Water (Power), Dept/Div. No. 60-07, Voted Street Lighting and Electricity Distribution Improvements Fund, Fund No. 553, Object Level One 06, Object Level Three 6621, as follows:

SECTION 4.  That the 2008 Capital Improvements Budget is hereby amended as follows:

SECTION 5.  That for the purpose of reimbursing Franklin County, the following expenditure, or as much thereof as may be needed is hereby authorized as follows:  Division of Power and Water (Power), Dept./Div. No. 60-07, Voted Street Lighting and Electricity Distribution Improvements Fund, Fund No. 553, Project No. 670788 Object Level One 06, Object Level Three 6621, Amount $42,415.47.
 
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 9.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
