Explanation
 
Background:  The Recreation and Parks Department received bids on May 20, 2008 for the Three Creeks Park - Sycamore Fields and Wheeler Park Off Leash Areas project.  Bid responses were received from the following vendors:

It is the recommendation of the Department to award the bid to Law General Contracting, Inc. in accordance with the plans and specifications on file in the Recreation and Parks Department.
 
The project includes:
 
Base Bid -  Three Creeks Park - Sycamore Fields Park Off Leash Area Improvements: supply and installation of:  concrete and asphalt walkways; asphalt parking area; parking lot striping; parking blocks; benches, trash receptacles and concrete bases; storm drainage system; earthwork, fine grading and seeding; plant material; park signage; wood fence and metal infill, service gates and self closing latches and any such work as may be necessary to complete the contract in accordance with the plans and specifications.
 
ALTERNATE #1S:  for supply and installation of a wood information kiosk.
 
ALTERNATE #2S:  for supply and installation of a water line and water hydrant.
 
Base Bid -  Wheeler Park Off Leash Area Improvements:  removal of concrete paving, base and site furnishings; removal of low brick wall; supply and install park and rules signage; metal decorative 48" fence, service gate and self closing gates; concrete paving; topsoil and plant material; removal of existing and supply and installation of (6) light poles, poles and finials; earthwork and fine grading; supply and installation of soil and seeding, aeration of turf in off leash area, and any such work as may be necessary to complete the contract in accordance with the plans and specifications.
 
ALTERNATE #1W:  for supply and installation of five (5) 6' long metal picnic tables with two side benches and three (3) trash receptacles and concrete bases.
 
ALTERNATE #2W:  for the supply and installation of three (3) 6' divided metal benches with backs and one (1) 4' metal backless bench with concrete bases.
 
ALTERNATE #3W:  for the supply and installation of metal information kiosk and concrete base.
 
ALTERNATE #4W:  for the supply and installation of water supply - line and fittings, tap, meter (water service) and yoke, lock box, backflow preventer, meter pit and water hydrant.
 
A contingency in the amount of $19,192.00 is included in this project.
 
The contract compliance number for Law General Contracting, Inc. is #31-1360543.  Contract compliance expires 02/27/09.
 
Emergency action is requested to so that the project can begin immediately in a timely manner in order to allow for completion during the summer season.
 
Fiscal Impact:  Funding for the project will come from the Voted 1999/2004 Recreation and Parks Bond Fund:  Fund: 702, OCA Code: 644526, Object Level: 6621, Project No.: 510320, Dog Parks, Amount: $375,000 and Fund: 702, OCA Code: 644526, Object Level 3: 6621, Project No.: 510017, Park and Play, Amount: $5,000.

To authorize and direct the Director of Recreation and Parks to enter into contract with Law General Contracting, Inc. for the Three Creeks Park - Sycamore Fields and Wheeler Park Off Leash Areas project in accordance with the competitive bidding procedures of the Columbus City Code, to authorize the expenditure of $380,000.00 from the Voted 1999/2004 Recreation and Parks Bond Fund, and to declare an emergency.  ($380.000.00)
 
Body
 
WHEREAS, the Recreation and Parks Department desires to enter into contract with Law General Contracting, Inc. for the Three Creeks Park - Sycamore Fields and Wheeler Park Off Leash Areas project; and
      
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with Law General Contracting, Inc. so that the project can begin immediately in order to allow for completion during the summer season; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Law General Contracting, Inc. for the Three Creeks - Sycamore Fields and Wheeler Park Off Leash Areas project  in accordance with the terms and conditions of the competitive bidding procedures of the Columbus City Code.
 
SECTION 2.   That the expenditure of $380,000.00, or so much thereof as may be necessary, be and is hereby authorized from the 1999/2004 Voted Recreation and Parks Bond Fund as follows, to pay the cost thereof:

SECTION 3.   That for the purpose of paying for any contingencies which may occur during this project, the amount of $19,192.00 has been included in Section 2, above.  This amount will be expended only after approval by the Director of the Recreation and Parks Department, certification by the City Auditor, and approval of the City Attorney.
 
SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
