Explanation

The Director of Public Safety and police officers are given the authority to issue warnings and/or fines of $25 for youth under the age of 18 who fail to wear a safety helmet when operating or riding as a passenger on a bicycle or other non-motorized vehicle, such as a scooter. Any money collected from such fines is to be used for the purchase of safety helmets for low-income children. This legislation creates the Bicycle Safety Fund for the deposit of such fines.

To authorize and direct the City Auditor to create the Bicycle Safety Fund for the deposit of fines collected as a result of the enforcement of the protective helmet requirements of Chapter 2173 of the Columbus City Codes, 1959.



Body

Whereas, in Ordinance No. 0950-2008, this Council enacted youth safety helmet requirements as part of the Traffic Code; and

Whereas, that ordinance provided that all fines collected for violations of the youth safety helmet requirements be deposited in the Bicycle Safety Fund; and

Whereas, this ordinance is necessary in order to create that Fund and to establish the purposes for which monies in that Fund may be expended; now therefore

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

Section 1. That the City Auditor is hereby authorized and directed to establish fund/subfund no. 223-304, titled Bicycle Safety Fund.

Section 2. That all revenues arising from the enforcement of the youth safety helmet requirements set forth in Section 2173.02 of the Columbus City Codes, 1959, as amended by Ordinance No. 0950-2008, shall be deposited into fund 223-304.

Section 3. That such monies shall be limited in their use to assist families with a household income not to exceed 185% of the Federal Poverty Income Guidelines in the purchase of safety helmets approved by the U.S. Consumer Product Safety Commission.
