Explanation
 
Background:  This ordinance authorizes the Franklin County Municipal Court Clerk to modify and increase the amount of the second year of a three contract with Huntington National Bank for the provision of bank and credit card services; to authorize an expenditure of $47,100.00 from the Clerk's general fund; to authorize an expenditure of $32,900.00 from the Clerk's computer fund; and to declare an emergency. ($80,000.00)
 
The Clerk's office receives earnings credits on funds deposited with the Huntington National Bank that are utilized to offset the bank charges.  The earnings credit rate is based on Federal funds rate.  The Federal funds rate decreased from 5.25% in 2007 to 2% in 2008, causing a shortfall in earnings credit; therefore, additional funds are needed to cover the bank and credit card charges for the remainder of the second year of the contract.
 
Ordinance 2167-2006 approved by Council on December 11, 2006 authorized the first year of a three contract with Huntington National Bank for the provisions of bank and credit card services.
 
The Ohio Revised Code, section 1901.31 (G), empowers the Franklin County Municipal Court Clerk to select the depository of its funds without engaging in competitive bidding.  However, an informal bidding process was used to solicit for the services.
 
Fiscal Impact:  Sufficient funds are available within the Clerk's 2008 general fund budget and computer fund budget.

Whereas, on December 11, 2006, Council approved ordinance 2167-2006 to establish a three year contract with Huntington National Bank for the provision of bank and credit card services for the Franklin County Municipal Court Clerk's office; and
 
Whereas, the second year of the three contract expires on December 31, 2008; and,  
 
Whereas, the Clerk's office receives earnings credits on funds deposited with Huntington National Bank,  utilized to offset bank charges; and
 
Whereas, the earnings credit rate is based on the Federal funds rate which has declined from 5.25% in 2007 to 2% in 2008, causing a shortfall in earnings credit; and
 
Whereas, it is necessary for the Clerk to expend an additional $80,000.00 with Huntington National Bank for the provision of  bank and credit card charges for the remainder of the second year of a three year contract; and,
 
Whereas, an emergency exists in the daily operations of the Franklin County Municipal Court Clerk's office in that it is necessary to authorized such contract to continue the bank services without interruption, for the immediate preservation of the public peace, health, safety and welfare, now therefore,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBES:
 
Section 1.  That the Franklin County Municipal Court Clerk is authorized and directed to modify and increase the amount of the second year of a three year contract with Huntington National Bank in the amount of $80,000.00, for the provision of bank and credit card services.
 
Section 2.  That the expenditure of $47,100.00 or so much thereof as may be necessary is hereby authorized to be expended from the Clerk's general fund, fund 010, subfund 01, department 2601, oca 260166, object level one 03, object level three 3348 to contract with the Huntington National Blank and that the Auditor is hereby authorized to draw warrants upon the treasury for services there under upon receipt of invoices from the Franklin County Municipal Court Clerk.
 
Section 3.  That the expenditure sum of $32,900.00 or so much thereof as may be necessary is hereby authorized to be expended from the Clerk's computer fund, fund 227, subfund 02, department 2601, oca 260208, object level one 03, object level three 3369 to contract with Huntington National Blank and that the Auditor is hereby authorized to draw warrants upon the treasury for services there under upon receipt of invoices from the Franklin County Municipal Court Clerk.
 
Section 4.  That in accordance with 329.27 of the Columbus City Code, Council found that the best interest of the City was served by waiving Section 329.06 (Competitive Sealed Bidding) of the Columbus City Code.
 
Section 5.  That for reasons stated in the preamble hereto, where is hereby made a part hereof, this ordinance is hereby declared an emergency measure, which shall take effect and be in force from and after its passage and approved by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
