Explanation
 
Background:  
This legislation will authorize the Director of Recreation and Parks to enter into a contract with Gaddis and Sons, Inc. for structural repair work of the sidewalk in front of the King Arts Complex.  During the demolition phase of the existing sidewalk, the contractor discovered that the walk covered a basement vault that extended beyond the facia of the building into the public right-of-way.  The work was stopped immediately and the hole was covered with a steel plate.  After an inspection by the Department of Public Service, Division of Transportation, and subsequent recommendations by a structural engineering firm, repair work will include the following:  secure the area and provide adequate pedestrian and traffic control, support and maintain existing utilities currently below the sidewalk, demolish and remove the existing structural sidewalk, install structural steel system, install a concrete reinforced structural slab and water proofing, replace the plain concrete walk and decorative brick stamped concrete walk, clean up construction debris daily, mobilization and demobilization, weather protection, supervision and construction inspection.   
 
The Contract Compliance Number for Gaddis and Sons, Inc. is #31-0818069 and the compliance date is effective through August 31, 2009.
 
Emergency action is requested because the substructure is rapidly deteriorating and poses a potentially dangerous situation if it is not repaired in a timely manner.
 
Fiscal Impact:
Funding for this project is available in the 1999/2004 Recreation and Parks Bond Fund.

Body
 
   WHEREAS, the structural sidewalk in front of the King Arts Complex is rapidly deteriorating and needs immediate attention; and
 
    WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into this contract because the substructure is rapidly deteriorating and poses a potentially dangerous situation if it is not repaired in a timely manner, and for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
     SECTION 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Gaddis and Sons, Inc. for sidewalk repair at the King Arts Complex.
 
    SECTION 2.   That this Council finds it in the best interest of the City of Columbus to waive the requirements of competitive bidding for, and does hereby waive the provisions of Section 329.07 of the Columbus City Codes.
 
    SECTION 3.   That the expenditure of $43,050.00, or so much thereof as may be necessary, be and is hereby authorized from the Voted 1999/2004 Recreation and Parks Bond Fund as follows, to pay the cost thereof:

     SECTION 4.   That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
 
    SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
