Explanation
 
BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a contract for the installation of a street lighting system with underground wiring under the assessment procedure.  Property owners have submitted a petition for a high pressure sodium street lighting system with ornamental poles and underground wiring for the Case Road area, including Case Road from Cleveland Avenue to the city corporation limit east of Walford Street.  This legislation also authorizes the transfer of funds from the Voted Street Lighting and Electricity Distribution Improvements Fund for the City's share in the cost of installing the street lighting system.
 
Resolution No. 0094X-2007, adopted July 9, 2007, authorized the preparation of plans and specifications.  Resolution of Necessity 0192X-2007 was adopted December 10, 2007.  Ordinance Number 0449-2008, Determine to Proceed, was passed March 31, 2008.
 
Five bids were received and opened by the Director of Public Utilities on June 4, 2008, against Solicitation No. SA002903:  U.S. Utility Contractor Co. $57,203.07; Jess Howard Electric $59,738.53; Tip-Dan Electric $60,649.27; Complete General $77,892.10; and M.P. Dory $87,244.30.  The Division of Power and Water recommends an award to U.S. Utility Contractor Co., 3115 East Seventeenth Avenue, Columbus, Ohio 43219, in the amount of $57,203.07, as the lowest, responsive, and responsible bid received.  Their Contract Compliance Number is 34-1606689 (expires 2/28/10, F1).

Emergency action is requested due to citizens' approved petition for a timely implementation of construction services.
 
FISCAL IMPACT:  The determined amount to be paid for the City's share under the Case Road Street Lighting Assessment Project is $12,000.00.  This legislation is a companion to Ordinance 1146-2008, which authorizes the issuance and sale of special assessment bond anticipation notes in the amount of $69,000.  There is sufficient funding authority in the Case Road Street Lighting Assessment Project.

WHEREAS,  property owners have submitted a petition for a pedestrian-scale street lighting system with buried cable, twelve aluminum post-top poles, concrete reinforced foundations and high pressure sodium acorn luminaries along Case Road; and
 
WHEREAS, the Case Road Street Lighting Assessment area includes Case Road from Cleveland Avenue to the City Corporation limit east of Walford Street; and
 
WHEREAS, U.S. Utility Contractor Co. submitted the lowest, responsive, and responsible bid opened by the Director of Public Utilities on June 4, 2008 for the installation of the aforesaid street lighting system; and
 
WHEREAS, funding is necessary to pay for construction costs, design, construction inspection, engineering, advertising and printing, and any other miscellaneous expenses for said project; and
 
WHEREAS, it is necessary to transfer funds from the Voted Street Lighting and Electricity Distribution Improvements Fund into the Street Lighting Assessment Fund to provide for the City's share in the cost of installing a street lighting system with underground wiring in the Case Road Street Lighting Assessment Project area under the assessment procedure; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water, in that it is immediately necessary to enter into a contract for labor and material for the construction of street lighting improvements in the Case Road Street Lighting Assessment Project area, in an emergency manner in order to complete financial transactions and enter into a contract to comply with citizens' approved petition for timely implementation of construction services, for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Auditor is hereby authorized and directed to transfer $12,000.00  within the Voted Street Lighting and Electricity Distribution Improvement Fund 553 as follows:

SECTION 2.  That the City Auditor is hereby authorized and directed to transfer $12,000.00  from the Voted Street Lighting and Electricity Distribution Improvement Fund 553 into the Street Lighting Assessment Fund 580, Division No. 60-07, as follows:

SECTION 3.  That the City Auditor is hereby authorized to appropriate $81,000.00 in the Case Road Street Lighting Assessment Project, Fund No. 580, Subfund 994, OCA 580994, Object Level Three 6625.
 
SECTION 4.  That the Director of Public Utilities be and hereby is authorized to enter into a contract with U.S. Utility Contractor Co., in the amount of $57,203.07, to install a high pressure sodium street lighting system with ornamental poles and underground wiring for the Case Road Street Lighting Project Area, and to obtain and pay for the services of the Division of Power and Water, the Transportation Division, and any services of other City Divisions as may be necessary up to a maximum amount of $23,796.93, for a grand legislative total of $81,000.00.
 
SECTION 5.  That to pay the cost of the aforesaid contract and expenses, the expenditure of $81,000.00, or so much thereof as may be needed, be and is hereby authorized from Division of Power and Water, Division No. 60-07, Fund No. 580, Subfund No. 994, Case Road Street Lighting Assessment Project, OCA 580994, OL3 6625.
 
SECTION 6.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 7.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 8.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.
 
SECTION 9. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
