Explanation

 

BACKGROUND:  This legislation authorizes the Finance and Management Director to modify a contract with Decker Construction for the renovation of the site at 1393 East Broad Street.  Ordinance 1782-2007, passed November 28, 2007, authorized the renovation of 1393 East Broad Street, including exterior and interior improvements to the building and to the site by addressing projects such as site grading, site utilities, site paving, site fencing, a small entrance addition to the building, and new HVAC equipment and distribution  This modfication will allow for additional concrete walks, ADA (Americans with Disabilities Act) ramps, and paving providing necessary site improvements to the facility.  The need for ADA ramps was not apparent at the beginning of the project. 

 

Because Decker Construction had already completed a large proportion of the renovation work, it was determined to be impractical to select another firm to complete the work.  This would have resulted in inefficiencies and potential confusion in the project.

 

Emergency action is requested to provide necessary ADA improvements to the facility, thereby ensuring the safety of the patrons of this building.

 

Fiscal Impact:  The cost of this contract was authorized by Ordinance Number 1782-2007, passed November 28, 2007, in the amount of $193,870.00.  This modification is for $39,560.00, thereby increasing the total contract to $233,430.00.  Funding is available from the Construction Management Capital Improvement Fund.

To authorize the Finance and Management Director to modify a contract for the Office of Construction Management with Decker Construction for site renovations at 1393 East Broad Street; to authorize the expenditure of $39,560.00 from the Construction Management Capital Improvement Fund; and to declare an emergency. Body

 

WHEREAS, Ordinance 1782-2007, passed November 26, 2007, authorized the Finance and Management Director to contract with Decker Construction for the renovation of the site at 1393 East Broad Street, and

 

WHEREAS, it is necessary to modify the original contract in order to provide additional concrete walks, ADA ramps, and paving, and

 

WHEREAS, said modifications will provide necessary site and safety improvements to the facility, and

 

WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Finance and Management Director to modify the contract with Decker Construction for site improvements at 1393 East Broad Street to the concrete walks, ADA ramps, and paving, thereby providing safe access to all of users of the building, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS: 

 

SECTION 1.  That the Finance and Management Director is hereby authorized to modify a contract with Decker Construction for site improvements at 1393 East Broad Street.

 

SECTION 2.   That the expenditure of $39,560.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
