Explanation
Background:
The Recreation and Parks Department solicited bids for the Krumm Park Improvements Project. Three (3) bids were received and opened by the Recreation and Parks Department on June 24, 2008. The bids are as follows:

It is the recommendation of the Recreation and Parks Department to award the bid to Builderscape, Inc. who submitted the lowest and best responsive and responsible bid.
This project was identified by the Krumm Park community as a priority in their UIRF grant proposal. The Department worked with the community to coordinate the design of this project which will update and correct the drainage issues at the entrance to the Recreation Center. The project includes the supply and installation of site furnishings that include the following: entrance canopy, boulders, drainage system, paving, plant material; supply and installation of outdoor hockey barriers for the in-line hockey rink and sports equipment; and supply and installation of pervious concrete (an environmentally friendly product that will reduce run-off) pavement in place of colored concrete and any such work as may be necessary to complete the contract in accordance with the plans and specifications on file in the Recreation and Parks Department.
A project contingency in the amount of $7,697.00 is included in this legislation.
The Contract Compliance Number for Builderscape, Inc. is #20-0537419 and the contract compliance is effective through 08/21/09.
Emergency action is requested so that the project can begin immediately in order to allow for the proper concrete placement prior to the changing climate conditions.
Fiscal Impact:
$150,000.00 is required and budgeted in the 1999/2004 Recreation and Parks Voted Bond Fund to meet the financial obligation of this contract.

To authorize the Director of Recreation and Parks to enter into contract with Builderscape, Inc. for the Krumm Park Improvements Project, to authorize the expenditure of $150,000.00 from the 1999/2004 Recreation and Parks Voted Bond Fund, and to declare an emergency. ($150,000.00)
Body
WHEREAS, bids were received by the Recreation and Parks Department on June 24, 2008 and the contract for the Krumm Park Improvements Project will be awarded to Builderscape, Inc. on the basis of the lowest and best responsive and responsible bidder; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with Builderscape, Inc. in order to allow the proper concrete placement prior to the changing climate conditions; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Builderscape, Inc. for the Krumm Park Improvements Project, in accordance with the plans and specifications on file in the Recreation and Parks Department.
SECTION 2. That the expenditure of $150,000.00, or so much thereof as may be necessary, be and is hereby authorized, to pay the cost thereof, as follows:

UIRF Improvements
SECTION 3. That for the purpose of paying for any contingencies which may occur during this project, the amount of $7,697.00 has been included in Section 2, above. This amount will be expended only after approval by the Director of the Recreation and Parks Department, certification by the City Auditor, and approval of the City Attorney.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
