Explanation
 
BACKGROUND:  This ordinance authorizes the Director of Finance and Management to enter into contract for the Office of Construction Management with The Quandel Group for the construction of a new Police Heliport, 2130 West Broad Street.  This project is necessary for construction of a new 29,900 square foot facility on 12.6 acres to include:  two hangar bays with connecting office area, detached fuel farm, tarmac, new utilities to the site, and paving.  The first floor is to have an entry/office area, an apparatus bay to properly store seven helicopters, and a maintenance area.  The second story is to include a lounge, break area, training rooms, restrooms, a shower area, locker rooms, office areas, and a flight control room.  The site is to include adequate parking, three landing pad tarmacs with jet fuel storage, fencing, lighting, and security.  All of these design services are to include environmentally responsible components in compliance with the Mayor's policy directive "Get Green Columbus 2005: Environmental Stewardship in the 21st Century."  
 
Formal bids were solicited and eleven companies submitted bids on June 26, 2008 as follows (0 FBE, 0 MBE):

The bids represent the grand total without Alternate C-1, (concrete paving).  The asphault paving alternate was selected.  A fixed contingency of $225,000.00, three allowances for capacity/tap fees , Electric Division Services, and furniture, fixtures, and equipment, and three alternates for cable, exercise equipment, and asphalt paving were included.   The Office of Construction Management recommends the bid award be made to the most responsive and responsible and best bidder, The Quandel Group.
 
The Daimler Group attempted to submit a bid; however, the bid was submitted five minutes late, and therefore not accepted.
 
This ordinance also waives the bidding requirements of the Columbus City Codes.  The original bid submitted by The Quandel Group included a mathematical error in the calculation of their grand total.  However, all of sub-totals were correct and are reflected above.  In communication with The Quandel Group, the City has verified that the subtotal amounts were the amount that The Quandel Group intended to bid.  Because of this error, it is necessary to waive bidding in order to ignore the original erroneous bid and accept the corrected bid.
EMERGENCY ACTION is requested for construction of the new Police Heliport, 2130 West Broad Street, thereby, providing the City of Columbus citizens needed safety services.  
 
The Quandel Group, Inc. Contract Compliance Number 23-2315218, Expiration date 08/30/2009.
 
FISCAL IMPACT:  The cost of this contract is $6,637,050.00. The Division of Police will provide funding for this project, through the Safety Voted Bond Fund.

Body
 
WHEREAS, it is necessary for the construction of a new Police Heliport, 2130 West Broad Street; and
 
WHEREAS, construction of the new Police Heliport will provide the City of Columbus citizens needed safety services; and
 
WHEREAS, The Quandel Group is the most responsive, responsible, and best bidder, and
 
WHEREAS, it is in the best interest of the Finance and Management Division, Office of Construction Management to waive the competitive bidding requirements of the Columbus City Codes, and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Construction Management, in that it is immediately necessary to authorize the Director of Finance and Management to enter into contract with The Quandel Group for the construction of the new Police Heliport, 2130 West Broad Street, to provide the City of Columbus citizens needed safety services, thereby preserving the public health, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Finance and Management is hereby authorized to enter into contract for the Office of Construction Management with The Quandel Group for the construction of a new Police Heliport, 2130 West Broad Street.
 
SECTION 2.  That the expenditure of $6,637,050.00, or so much thereof as may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3.  That in accordance with Section 329.27 of the Columbus City Code, City Council has determined that it is in the best interest of the City of Columbus that Section 329.09 relating to the process for awarding construction contracts exceeding twenty thousand dollars be waived and hereby waives said section.
 
SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.  
 
SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
