Explanation
 
Background:  This ordinance will  authorize a modification to Contract No. EL006976 for additional construction services with Hopewell Constructors, Inc.,  related to the Whetstone Recreation Center Improvements Project.  The project includes renovation of the existing Whetstone Recreation Center as well as the addition of a new community room.  Unforseen changes and utility issues have necessitated a contract extension resulting in this modification.
 
Changes include connection requirements by Columbia Gas and external issues by the City of Columbus, Division of Electricity; building items such as flooring under layment, plumbing issues discovered during demolition that required additional work to meet code requirements, roof substrate that was discovered during demolition that needed to be removed, undocumented asbestos removal, window detail modifications to allow for new window installation and stairwell modifications to meet fire code.  All of these items required additional time and work by the contractor which delayed the project.
 
The amount of this modification is $186,319.94 bringing the total modified contract cost to $5,777,089.50.
 
The Contract Compliance Number for Hopewell Constructors, Inc., is #31-1472318 and the expiration date is 11/30/08.
 
Emergency legislation is requested to allow work to be completed as soon as possible in order to be ready for an early September re-dedication.
 
Fiscal Impact:  $186,319.94 is required and budgeted in the 1999/2004 Recreation and Parks Voted Bond Fund to meet the financial obligation of this contract modification.

To authorize a contract modification with Hopewell Constructors, Inc. for additional construction services related to the Whetstone Recreation Center Renovation Project, to authorize the expenditure of $186,319.94 from the 1999/2004 Recreation and Parks Voted Bond Fund, and to declare an emergency.  ($186,319.94)
 
Body
 
      WHEREAS, it is necessary to modify the contract with Hopewell Constructors, Inc. for additional construction services related to the Whetstone Recreation Center Renovation Project; and
 
      WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to modify the construction service contract to allow work to be completed as soon as possible in order to be ready for an early September re-dedication; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
    SECTION 1.   That the Director of Recreation and Parks be and he is hereby authorized and directed to modify Contract No.  EL006976 with Hopewell Constructors, Inc., for additional construction services related to the Whetstone Recreation Center Renovation Project, in accordance with the plans and specifications on file in the Recreation and Parks Department.
 
    SECTION 2.   That the expenditure of $186,319.94 or so much thereof as may be necessary, be and is hereby authorized from the 1999/2004 Recreation and Parks Voted Bond Fund No. 702; Dept. No. 51-01; Facility Improvements, Project No. 510035; OCA Code 644526; Object Level 3 No. 6620, to pay the cost thereof.
 
    SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
 
    SECTION 4.   That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
    SECTION 5.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
