BACKGROUND: This ordinance authorizes the Directors of the Departments of Development and the Public Service to enter into a development agreement with Central Ohio Housing Development Organization, Inc., for street and infrastructure improvements in the public right of way. The project, American Addition, is in the Columbus Public School District and has boundaries of Twelfth Avenue to the north, Dewey Avenue to the south, Joyce Avenue to the west and Puritan Avenue to the east. This legislation is for infrastructure improvements for the first phase of the development which begins with a new water line running from Joyce Avenue down to Woodford Avenue and includes all necessary infrastructure improvements beginning at Woodford Avenue from the west side of the intersection of Sigsbee Avenue to the east side of the intersection of Miantonomah Alley, Lee Avenue from Woodford Avenue to Helena Alley and south on Lee Avenue in the public right of way to Dewey Avenue. The project in total will consist of 120 redeveloped lots in total with 12 homes constructed in the first phase.
 
Emergency action is requested so that the development agreement can be in place during the construction season.
 
FISCAL IMPACT:  Funds for this project are from the Northland and Other Acquisitions Fund.

WHEREAS, the Directors of the Departments of Development and Public Service desire to enter into a Development Agreement with the Columbus Housing Partnership for the first phase of street and infrastructure improvements in the public right of way as part of the American Addition Project, Capital Improvement Program; and
 
WHEREAS, Article I. Chapter 901.01 of the Code of the City of Columbus, Ohio 1959, authorizes the Directors of the Departments of Development and Public Service to enter into an agreement providing for such improvements; and
 
WHEREAS, the project, American Addition is in the Columbus Public School District and the first phase begins with a new water line running from Joyce Avenue down to Woodford Avenue and includes all necessary infrastructure improvements beginning at Woodford Avenue from the west side of the intersection of Sigsbee Avenue to the east side of the intersection of Miantonomah Alley, Lee Avenue from Woodford Avenue to Helena Alley, and south on Lee Avenue in the public right of way to Dewey Avenue. The project in total will consist of 120 redeveloped lots in total with 12 homes constructed in the first phase; and
 
WHEREAS, the development agreement will provide for the reimbursement of costs of constructing infrastructure improvements in the public right of way for 12 single-family infill homes; and
 
WHEREAS, an emergency exists in the usual daily operation of the Departments of Development and Public Service in that it is immediately necessary to enter into a development agreement for infrastructure construction reimbursement as part of the Columbus Housing Initiatives Project Capital Improvement Program so that development agreements can be in place during the construction season, thereby preserving the public health, peace, property, safety and welfare; and, NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.      That the Directors of the Departments of Development and Public Service are hereby authorized to enter into a development agreement with Central Ohio Housing Development Organization (a not-for-profit affiliate of the Columbus Housing Partnership) for the reimbursement of costs of constructing infrastructure improvements for 12 homes in the American Addition Project.
 
Section 2.      That this development agreement is a guaranteed fixed price contract whose total amount shall not exceed $1,000,000.00, including inspections, pursuant to City Charter, Section 186.
 
Section 3.      That the sum of $1,000,000.00, or so much thereof as may be necessary, be and is hereby authorized to be expended from Northland and Other Acquisitions Fund 735, Housing Division, Department No. 44-10, Object Level One Code 06, Object Level Three Code 6631, OCA Code 441735 and Project No. 590415.
 
Section 4.      That for the reasons stated in the preamble thereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
