Explanation
 
1.  BACKGROUND:
The Transportation Division is responsible for mowing along the City's roadway system; and due to the advanced age and wear of its existing equipment, it is imperative that the Director of Finance be authorized to purchase two replacement tractors with four sets of mowers.  This replacement equipment is necessary to enable the Division to maintain its existing level of service, and only replaces older equipment that has exceeded its useful service life and to provide for a more reliable, cost effective fleet.
 
This purchase will be in accordance with the current State of Ohio State Term Schedule (STS) Contract, STS778515Z which expires on September 30, 2008.  
 
Supplier:  Steinke Tractor Sales, Inc., 707 South Barron Street, Eaton, OH 45320
Contract Compliance Number: 310975831, expires 7/3/10
 
The quotation is on file with the Purchasing Office.  This purchase has been approved by the Fleet Management Division.  This equipment does not offer environmentally preferred fuel options at this time.
 
2.  EMERGENCY ACTION:
The Division is requsting that City Council consider this an emergency measure in order to allow for the immediate continuation of these urgent roadway mowing services.
 
3.  FISCAL IMPACT:
Funds are available for this expenditure from the Streets and Highways G.O. Bonds Fund, no. 704.

Body
WHEREAS, the Transportation Division is responsible for mowing along the City's roadway system, and
 
WHEREAS, the Transportation Division wishes to purchase two tractors and four sets of mowers using the State of Ohio State Term Schedule (STS) Contract, STS778515Z which expires on September 30, 2008, and
 
WHEREAS, the City of Columbus does not include this type of equipment on any Universal Term Contract, and
 
WHEREAS, this purchase has been approved by Fleet Management and this equipment does not offer environmentally preferred fuel options at this time, and
 
WHEREAS, funding is based on quotes dated June 26, 2008 submitted by Steinke Tractor Sales, Inc., and the quoted prices reflect State of Ohio contract pricing and is on file with the Purchasing Office, and
 
WHEREAS, funds are budgeted and available in the Streets and Highways G.O. Bonds Fund for this expense, and
 
WHEREAS, an emergency exists in the usual daily operation of the Transportation Division, Department of Public Service in that it is immediately necessary to purchase two tractors and four sets of mowers in order to allow for the immediate continuation of these urgent roadway mowing services for the immediate preservation of the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2008 Capital Improvements Budget established within ordinance 0690-2008 be and hereby is amended to provide funding for this project as follows:
 
704 / 590105-100000 / Pedestrian Safety (Carryover) / $2,810,125.00 (Carryover) / ($132,126.00) (Carryover) / $2,677,999.00 (Carryover)
704 / 530020-100000 / Street Equipment (Carryover) / $109,829.00 (Carryover) / $132,126.00 (Carryover) / $241,955.00 (Carryover)
 
SECTION 2.  To authorize the City Auditor to transfer funds between projects within Fund 704, the Streets & Highways G.O. Bonds Fund as follows:

SECTION 3. That the sum of $132,125.74 or so much thereof as may be needed is hereby authorized to be expended from the Streets and Highways G.O. Bonds Fund, No. 704, Dept./Div. 59-09, OCA Code 644385, O.L. 01-03 Codes 06-6651, Project  Number 530020.
 
SECTION 4.  That funding for this legislation is based on quotes dated June 26, 2008 submitted by Steinke Tractor Sales, Inc., and the quoted prices reflect State of Ohio contract pricing and is on file with the Purchasing Office.
 
SECTION 5.  That the Finance Director is hereby authorized to establish a purchase order with Steinke Tractor Sales, Inc., 707 South Barron Street, Eaton, OH 45320, for the purchase of two tractors and four sets of mowers in accordance with the State of Ohio State Term Schedule (STS) Contract, STS778515Z which expires on September 30, 2008.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
