Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Service to enter into a professional engineering services contract with Korda/Nemeth Engineering, Inc.  
 
This project involves the preparation of a Preliminary Engineering document to recommend streetscape improvements to High Street from Convention Center Drive to King Avenue/E. Seventh Avenue. Considerations include but not be limited to street lighting, conversion of strain pole supported signal facilities to mast arm, conversion of overhead utilities (including private utility company facilities and City-owned facilities) to underground, curb extensions, sidewalk, bikeways, ADA compliance, and walkability improvements.
 
The primary stakeholders' key objectives are to improve safety, improve aesthetics of the streets (public right-of-way), improve pedestrian accessibility and mobility, build on the brand and reputation as an "Arts District" destination, and minimize business disruption during actual construction. The project may involve final engineering and construction plan preparation of one phase.
The Department of Public Service, Office of Support Services solicited Requests for Proposals for the Short North Streetscape Improvement contract.  The project was advertised through the City's Vendor Services web site from September 30, 2011, to November 3, 2011.  The city received Five (5) responses.  All Five were fully evaluated when the Evaluation Committee met on November 17, 2011.

Stantec Consulting Services and Korda/Nemeth Engineering, Inc. received the two highest scores by the evaluation committee.  Both firms provided oral presentations for the evaluation committee and it was determined that on the strength of their proposal and presentation Korda/Nemeth Engineering will be awarded the Short North Streetscape Improvement contract in an amount up to $500,000.00.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Korda/Nemeth Engineering Inc.
2.  PLANNED CONTRACT MODIFICATION
The scope of services for this contract is for preliminary engineering.  As additional funding is identified in the future a planned contract modification will occur to perform additional engineering services.
3. CONTRACT COMPLIANCE
The contract compliance number for Korda/Nemeth Engineering Inc. is 310922991 and Expires 7/6/13.
4. FISCAL IMPACT:
Funding for this contract is budgeted and available within the Streets and Highways G.O.Bonds Fund.
5.  EMERGENCY DESIGNATION
Emergency action is requested to provide funding for the professional services described above at the earliest possible time to provide for project analysis and improvements for pedestrian and travelling public at the earliest possible time.

WHEREAS, there is a need to provide professional engineering design services for the preliminary engineering of the Short North Streetscape project; and
 
WHEREAS, The Department of Public Service, Office of Support Services solicited Requests for Proposals for this project; and
 
WHEREAS, after initial proposals and subsequent oral presentations it was determined by the evaluation committee that Korda/Nemeth Engineering Inc. submitted the best overall proposal for this project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, in that this legislation should go forth immediately to provide funding for these engineering services to provide project analysis and design services for pedestrian and travelling public improvements at the earliest possible time, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and hereby is authorized to enter into a professional services contract with Korda/Nemeth Engineering Inc., 1650 Watermark Drive, Suite 200, Columbus, OH, 43215 for engineering services associated with the Short North Streetscape Improvement project.
SECTION 2.  That the expenditure of $500,000.00, or so much thereof as may be needed, be and hereby is authorized from the Streets and Highways G.O. Bonds Fund, Fund 704, Department No. 59-11, Division of Planning and Operations as follows:

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
