Explanation
1.      BACKGROUND:
This legislation authorizes the Director of Public Service to enter into a contract for the construction of the Operation Safewalks - Joyce Avenue Phase 1 Project.  The Department of Public Utilities will also participate in the project and construction of water lines, sewer lines and other DPU facilities will be included.
Work in this project includes the reconstruction of East Hudson Street from just east of Cleveland Avenue to a point 500 feet east of Joyce Avenue.  Joyce Avenue will be reconstructed from just north of East Hudson Street to just north of Kenmore Avenue.  East Hudson Street will be milled and paved from where the reconstruction ends to just west of Parkwood Avenue. Total length of reconstructed roadway (Hudson and Joyce) will be approximately 0.55 miles. 0.7 miles of 8 foot wide shared use path, 0.7 miles of 5 foot wide sidewalk, and 1.3 miles of curbing will also be installed.  42 ADA ramps will also be added or reconstructed in this project.
A water line, a storm sewer system and a detention basin will also be part of this project. Storm sewers will be installed on East Hudson Street from Dresden Street to Cleveland Avenue. This portion of the street will also be milled and overlaid. Storm sewer installation will also be included along Bancroft Street for 1,316 feet from East Hudson Street due north, Briarwood Avenue, Republic Avenue, Bremen Street and Linden Avenue.
 
The existing ditch (East Drainage Ditch) located west of Bancroft Street will be regraded over a length of 1,085 feet due north from East Hudson Street. Landscaping (trees) will also part of this project.
There are a number of bus transit routes within the limits of this project: COTA Routes No. 81 (along East Hudson Street and Joyce Avenue), No.74 (along East Hudson Street west of Cleveland Avenue), No. 1, 27,35,37,40 (along Cleveland Avenue).  
 
Pedestrian generators and destinations impacting the proposed project include residents walking to the bus stops, and to Hudson Market and the various small businesses along East Hudson Street.  Duxberry School of Arts located along Duxberry Road generates pedestrian traffic as well as industries along Joyce Avenue south of East Hudson Street.
Pedestrian Quality of Service analyses show a marked improvement due to features of this project such as sidewalk, ADA curb ramps, shared use path, new traffic signal, upgrades at the intersections, added left turn lanes, tree lawn.
The estimated Notice to Proceed date is March 26, 2012.  The project was let by the Office of Support Services through Vendor Services and Bid Express.  6 bids were received on February 9, 2012 (6 majority) and tabulated on February 10, 2012 as follows:

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Complete General Construction.
2.  CONTRACT COMPLIANCE
The contract compliance number for Complete General Construction is 314366382 and expires 11/1/13.
3.  FISCAL IMPACT
The Department of Public Service and Department of Public Utilities will provide funding for this project.  Funding authority for this project is budgeted within the 2011 Capital Improvement Budget within the Streets and Highways G.O. Bonds Fund for the Division of Design and Construction, the Storm Recovery Zone Super Build America Bonds Fund for the Division of Sewerage and Drainage (Stormwater), and Water Works Enlargement Voted Bonds Fund for the Division of Power and Water (Water).  A transfer of funds within the Storm Recovery Zone Super Build America Bonds Fund and an amendment to the 2011 Capital Improvements Budget is necessary to put sufficient cash and authority in the proper projects.
 
4. EMERGENCY DESIGNATION.
Emergency action is requested in order to allow this project to begin at the earliest possible time this construction season and to allow the sidewalks to be available to the public for the highest provision of pedestrian safety.

Body
WHEREAS, the City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the Operation Safewalks - Joyce Avenue Phase 1 project; and
WHEREAS, the Department of Public Utilities will also participate in this project and provide funding for construction of water lines, sewer lines, and other DPU facilities; and
WHEREAS, this project consists of the reconstruction of portions of East Hudson Street and Joyce Avenue, milling and paving of portions of these roadway, and construction of water lines, a storm sewer system and a detention basin; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Storm Recovery Zone Super Build America Bonds Fund; and
 
WHEREAS, it is necessary to authorize an amendment to the 2011 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the Linden Areawide Stormwater System Improvements Project; and
WHEREAS, project locations and work are described as follows:

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in order to maintain the project schedule and provide the sidewalks planned in this project to provide the highest level of pedestrian safety possible thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to enter into contract with Complete General Construction, 1221 East Fifth Avenue, Columbus, Ohio 43219 for the construction of  the Operation Safewalks  - Joyce Avenue Phase 1 project  in the amount of $6,440,771.03 or so much thereof as may be needed, for the Division of Design and Construction in accordance with the specifications and plans on file in the Office of Support Services, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $644,077.10.
SECTION 2.  That the City Auditor is hereby authorized to transfer $967,742.93 within the Division of Sewerage and Drainage, Stormwater, Dept/Div. No. 60-15, Storm Recovery Zone Super Build America Bonds Fund, Fund No. 677, as follows:

Bonds Fund, No. 704, for the Division of Design and Construction, Dept.-Div. 59-12, the Storm Recovery Zone Super Build America Bonds Fund for the Division of Sewerage and Drainage (Stormwater), and the Water Works Enlargement Voted Bonds Fund for the Division of Power and Water (Water) as follows:

SECTION 5.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
SECTION 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
