Title: To authorize the Director of Public Service to modify and increase an existing contract, with Dynotec, Inc, for professional services needed for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel Road project, for the Division of Design and Construction, to amend the 2011 C.I.B; to authorize the transfer and expenditure of $40,000.00 within the Streets and Highways G.O. Bonds Fund; and to declare an emergency. ($40,000.00)
Explanation
1.  BACKGROUND
This ordinance authorizes the Director of Public Service to modify and increase a professional engineering services contract, with Dynotec, Inc., for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road - Koebel Road project.  This is the ninth modification to the original contract.  This modification is  needed to complete the design of the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road - Koebel Road project, provide assistance during the bidding process, and to attend the pre-bid and pre-construction meetings to review  shop drawings and also to provide as-built drawings.
 
Work performed to date by the consultant for this project consisted of the  provision of professional design services for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road - Koebel Road project.  Additional work under this contract consisted of work for Department of Public Utilities projects.
This modification is necessary for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road - Koebel Road project.  Ordinance 0247-2005 authorized modification number 7 to this contract in the amount of $130,000.00 for the design of the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road - Koebel Road project. Other modifications of this contract were associated with the Department of  Public Utilities.
An additional engineering cost amount was originally set in the contract for this project to cover any unforeseen additional professional design services during the design and during the construction, however, plan updates were needed to bring the plans up to current standards and caused the depletion of these funds.
 
This modification will enable the City to use Dynotec's services to provide any services that may be needed during the bidding process and during the construction of this project. The amount of this modification is $40,000.00.
The intent of the modification is to provide professional design services during the construction of the project and other services mentioned above. To bid this portion of work would not be cost effective since the current designer is more familiar with their own design and with the intricacies of the plans.  
 
1.1 miles of 5 foot wide sidewalk will be added on both sides of Fairwood Avenue from Watkins Road to Koebel Road in this project and 24 ADA curb ramps will be constructed as part of this project.  There are 2 bus stops and transit routes within the limits of this project.   This project complies with the recommendation of the Pedestrian Thoroughfare Plan because it calls for the inclusion of sidewalks and tree lawns in the improvements.  The sidewalk and tree lawn widths were reviewed and approved by the Division of Mobility Options.
Pedestrian generators and destinations impacting the proposed project bus stops, Marion Franklin High School, Watkins Elementary School and Beery Elementary School.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Dynotec, Inc.
2.  CONTRACT COMPLIANCE
The contract compliance number for Dynotec, Inc. is 311319961 and expires 5/2/13.
3.  FISCAL IMPACT:
Funding for this project is available within the Streets and Highways G.O. Bonds Fund due to the cancellation of encumbrances from completed project.  C.I.B. amendments are necessary to provide authority in the correct project for this improvement.
4.      Emergency Justification
Emergency action is requested to allow pedestrian improvements contemplated by this project to be constructed as soon as possible for the highest level of pedestrian safety within this area.

WHEREAS, Contract No. EL900788 was authorized by Ordinance No. 1464-99, passed June 21, 1999; executed August 3, 1999; and approved by the City Attorney on August 5, 1999; and
WHEREAS, Modification No. 1 was authorized by Ordinance No. 601-01, passed April 16, 2001; was executed May 16, 2001; and
WHEREAS, Modification No. 2 was authorized by Ordinance No. 2146-01, passed December 10, 2001; was executed January 9, 2002; and
WHEREAS, Modification No. 3 was authorized by Ordinance No. 871-02, passed June 3, 2002; and
WHEREAS, Modification No. 4 was authorized by Ordinance No. 289-03, passed February 24, 2003; and
WHEREAS, Modification No. 5 was authorized by Ordinance No. 1664-2003, passed July 28, 2003; and
WHEREAS, Modification No. 6 was authorized by Ordinance No. 1540-2004, passed September 27, 2004; and
WHEREAS, Modification No. 7 was authorized by Ordinance No. 0247-2005, passed February 28, 2005; and
WHEREAS, Modification No. 8 was authorized by Ordinance No. 0757-2006, passed September 18, 2006; and
WHEREAS, additional funds are needed to complete the design of the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel project, provide assistance during the bidding process, to attend the pre-bid and pre-construction meetings to review  shop drawings and also to provide as-built drawings.; and
WHEREAS, it is necessary to modify Contract No. EL900788 to authorize the funds for the professional services described above  for the  Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel project; and
WHEREAS, this ordinance authorizes the Director of Public Service to execute a professional Services contract modification for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in order to maintain the project schedule and provide the sidewalks planned in this project to provide the highest level of pedestrian safety possible thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Service is hereby authorized and directed to modify and increase an existing professional engineering services contract, with Dynotec, Inc., 2931 East Dublin-Granville Road, Suite 200 for the Arterial Street Rehabilitation - Fairwood Avenue/Watkins Road-Koebel project, in the amount of $40,000.00.
SECTION 2.  That the 2011 Capital Improvement Budget authorized by ordinance 0266-2011 be and is hereby amended to provide sufficient authority for this project as follows:

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
