Title: To authorize the Director of the Department of Finance and Management to enter into a License Agreement with University District Organization, Inc. for a portion of the property located at 1425 Indianola Avenue for use as a community garden; and to declare an emergency.
 Explanation
Background: The City of Columbus owns certain real property commonly known as Fire Station #7 located at 1425 Indianola Avenue, Columbus, Ohio 43201, Franklin County Parcel Number 010-066707.  University District Organization, Inc., for the benefit of the Weinland Park Community Civic Association (WPCCA), desires to enter into a License Agreement to lease a vacant portion of the southeast corner of the site containing approximately .16 acre to allow the WPCCA to construct, install, operate, and maintain a community garden for the cultivation of annual vegetables and/or flowers. The use of the .16 acre portion of the City-owned parcel as a community garden will help promote healthy eating and healthy neighborhoods and supports City efforts including Get Green Columbus, Columbus Public Health - Institute for Active Living, and City neighborhood initiatives.
The WPCCA does not have the legal capacity to enter into a contract with the City so the University District Organization, Inc. has agreed to enter into contract with the City for the lease of the portion City's 1425 Indianola Avenue property on behalf of WPCCA for use as a community garden.
This ordinance authorizes the Director of Finance and Management to execute those document necessary to enter into a one (1) year license agreement with four (4) successive one-year term options for renewal with the University District Organization, Inc. for that .16 acre portion of the property located at 1425 Indianola Avenue to construct, install, operate, and maintain a community garden for the cultivation of annual vegetables and/or flowers.
Fiscal Impact:  N/A
Emergency Justification:  Emergency action is requested to enable the Weinland Park Community Civic Association to begin preparation of the site in April in order that to ready it for use in time for this year's planting and growing season.

Body
WHEREAS, the City of Columbus owns the property located at 1425 Indianola Avenue; and
WHEREAS, University District Organization, Inc., for the benefit of the Weinland Park Community Civic Association, desires to lease a vacant portion of the southeast corner of the site containing approximately .16 acre to construct, install, operate, and maintain a community garden for the cultivation of annual vegetables and/or flowers; and
WHEREAS, the use of the .16 acre portion of the City-owned parcel as a community garden will help promote healthy eating and healthy neighborhoods and supports the City's Get Green Columbus, Columbus Public Health - Institute for Active Living, and  neighborhood initiatives; and
 
WHEREAS, it is necessary to enter into a License Agreement with the University District Organization, Inc. for that portion of the property located at 1425 Indianola Avenue to construct, install, operate, and maintain a community garden for the cultivation of annual vegetables and/or flowers; and
WHEREAS, an emergency exists in the usual daily operation of the City, in that it is necessary to immediately authorize the Director of the Department of Finance and Management to enter into a License Agreement with the University District Organization, Inc. to allow Weinland Park Community Civic Association to immediately begin preparation of the site and soil for the planting of a community garden for this growing season thereby preserving the public health, property, safety, and welfare; now therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1.  That the Director of the Department of Finance and Management be, and hereby is, authorized to execute those documents approved by the Department of Law, Real Estate Division to enter into a one (1) year license agreement with four (4) successive one-year term options for renewal by and between the City of Columbus and University District Organization, Inc. for that .16 acre portion of the property located at 1425 Indianola Avenue, Columbus, Ohio to construct, install, operate, and maintain a community garden.
 
Section 2.  That the terms and conditions of this license shall be in a form approved by the City Attorney's Office and shall include the following:
a) The license shall have an initial term of one (1) year commencing April 1, 2012 and terminating March 31, 2012.
b)  The license will contain four (4) successive one (1) year renewal options and a termination provision.
c)   Such other terms and conditions as are required and/or approved by the City Attorney's Office.
Section 3. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
