Title: To authorize the City Attorney's Real Estate Division to contract for professional services relative to the acquisition of fee simple title and lesser interests needed for the Pedestrian Safety Improvements - Hague/Valleyview Safe Routes to Schools (SRTS) project; to authorize the City Attorney's Office, Real Estate Division, to hire professional services and negotiate with property owners to acquire the additional rights of way necessary to complete this project; to amend the 2012 C.I.B; to authorize the transfer of funds within the Streets and Highways G.O. Bonds Fund; to authorize the expenditure of $100,000.00 or so much thereof as may be necessary from the Streets and Highways G.O. Bonds Fund to acquire the rights of way needed for this project; and to declare an emergency. ($100,000.00)
Explanation
1.   BACKGROUND
The City of Columbus, Department of Public Service, Division of Mobility Options, is engaged in the Pedestrian Safety Improvements - Hague/Valleyview Safe Routes to Schools (SRTS) project. (CIP 590105-100032, Drawing # 2905 Dr. E)  The project limits are Valleyview Drive from Westmoore Avenue to Hague Avenue and Hague Avenue to Carol Avenue. The Department of Public Service is currently finalizing construction plans and is prepared to authorize right-of-way acquisition pending passage of this funding legislation.
Improvements include: Construction of a shared use path on the south side of Valleyview drive and on the west side of Hague Avenue from Westmoore Avenue to Carol Avenue, storm sewer, culvert replacement, railroad crossing with gates and signals, and ADA accommodations.
 
The following legislation authorizes the City Attorney's Office, Real Estate Division to hire professional services and to negotiate with property owners to acquire the various property rights necessary to complete this Pedestrian Safety Improvements project.  This legislation also establishes $100,000.00 in City Attorney Real Estate Division expenditure authority for the acquisitions related to the safety Improvements.
2.   FISCAL IMPACT
$100,000.00 will be funded from the Streets and Highways G.O. Bonds Fund.  It is anticipated additional funding for Right of Way will be legislated when an OPWC grant held by Franklin County, is executed.  The City and Franklin County are partnering in this project and utilizing the grant jointly.  Upon execution of the grant, additional funds will be available for right of way.
3.   EMERGENCY DESIGNATION
The Pedestrian Safety Improvements contemplated by this project are essential to the safety of those individuals living and travelling within this area. Failure to complete right of way acquisition for this project in a timely manner will delay the current construction schedule.  Emergency action is requested to allow right of way acquisition for this project to remain on schedule.

WHEREAS, the Department of Public Service, Division of Mobility Options is engaged in the Pedestrian Safety Improvements - Hague/Valleyview Safe Routes to Schools (SRTS) project; and
WHEREAS, it is necessary to hire professional services and to negotiate with property owners to acquire the various property rights necessary to complete this project; and
WHEREAS, this legislation authorizes the expenditure of $100,000.00 or so much thereof as may be necessary to allow the City Attorney's Office, Real Estate Division, to acquire those rights of way needed for this project; and
WHEREAS, it is necessary to amend the 2012 Capital Improvement Budget to provide sufficient authority for this expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that failure to complete right of way acquisition in a timely manner will delay this project.  Therefore, it is immediately necessary to authorize the City Attorney's Office to acquire the necessary rights of way and to authorize the expenditure of the funds needed to complete right of way acquisition, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Real Estate Division of the City Attorney's Office be and is hereby authorized to acquire fee simple title and lesser interests in and to property needed for the Pedestrian Safety Improvement - Hague/Valleyview Safe Routes to Schools (SRTS) project.
SECTION 2.  That the 2012 Capital Improvement Budget, authorized by ordinance 0368-2012 be amended as follows to provide sufficient authority for this project

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with this ordinance.
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
