Explanation
 
Background:
The Recreation and Parks department is seeking to purchase one (1) conventional diesel powered, crew cab and chassis truck with Forestry chipper dump body with options. The equipment will be used by the Division of Forestry Operations as part of the Department's emerald ash borer mitigation efforts.
 
Funding for the vehicle purchase was previously established via Ordinance 1905-2011 and is available per Auditor's Certificate 033035/003.
 
The Purchasing Office advertised and solicited competitive bids in accordance with Section 329.06 (Solicitation No. SA004268).  Fifty One (51) bids were solicited.  Four (4) bids were received.  Bids were received by the Purchasing Office March 15, 2012 as follows:

We are rejecting all bids:
Ricart Properties, Inc. dba Ricart Ford, Inc. was the apparent low bid but their bid was not of equal quality level per specification.
FYDA Freightliner submitted two (2) bids.  Their bids are being rejected because of the gas tank being on the opposite side of what the specification required.
Center City International is being rejected because the Department does not want to spend an extra $11,423.00 for the gas tank to be on specified side.
 
We are rejecting the bids and waiving competitive bidding to accept the lowest bid of equal quality to the specification which is FYDA Freightliner Columbus, Inc. with Ace Truck in the amount of $104,405.00 because the placement of the gas tank does not interfere with the performance of the vehicle and we do not expect any new bids at this time if we were to rebid.

Emergency Action:
      
An emergency exists in the usual daily operations of the Recreation and Parks Department in that it is immediately necessary to enter into said contract so that work can begin as soon as possible for Forestry to remove dead trees from the Emerald Ash Borer and make it safer for the public.
 
Fiscal Impact:  No fiscal impact required as part of this legislation.  Funding previously established per ord. #1905-2011 and AC#033035-003

Body
 
WHEREAS, this equipment purchase is necessary for the purpose of managing the Emerald Ash Borer project 2012 per Ordinance 1905-2011; and
 
WHEREAS, The FYDA Freightliner Columbus, Inc. is the most responsive, responsible, and best bidder; and
 
WHEREAS, it is in the best interest of the Recreation and Parks Department to waive the competitive bidding requirements of the Columbus City Codes; and
 
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into contract with  FYDA Freightliner Columbus, Inc for the management of the Emerald Ash Borer project 2012; NOW, THEREFORE
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Finance and Management Director be and is hereby authorized to enter into contract with FYDA Freightliner Columbus, Inc. for the purchase of one (1) crew cab and chassis with a forestry body;
 
SECTION 2.  That Section 329.06 of the Columbus City Code be waived in the best interest of the City;
 
SECTION 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance;
 
SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
