Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to enter into a contract for the construction of the Pedestrian Safety Improvements - Sidewalk Program project in the amount of $203,000 with associated construction inspection costs of $51,000, for a total expenditure of $254,000.  
 
This is an on-call contract for tree root related sidewalk and curb ramp construction.  This contract also includes work for crosswalk improvements and installation of medians, pavement markings and basic traffic signal equipment.
The estimated Notice to Proceed date is July 5, 2012.  The project was let by the Office of Support Services through Vendor Services and Bid Express.  3 bids were received on May 10, 2012 (3 majority) and tabulated on May 11, 2012 as follows:

The contract amount will be for $203,000.00 based on the bid documents allowing the City to award a contract for an amount less than the bid amount.
The amount of this contract will be $203,000.00.  Award is to be made to G&G Cement Contractors as the lowest responsive, responsible and best bidder.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against G&G Cement Contractors.
2.  CONTRACT COMPLIANCE
The contract compliance number for G&G Cement Contractors is 262560462 and expires 4/17/14.
3.  FISCAL IMPACT
Funding is budgeted and available within the Streets and Highways G.O. Bonds Fund  for this project.
 
4. EMERGENCY DESIGNATION
Emergency action is requested in order to allow this project to begin at the earliest possible time this construction season in order to make sidewalks available for the highest level of pedestrian safety.

Body
WHEREAS, the City of Columbus, Department of Public Service, Division of Design and Construction, is engaged in the Pedestrian Safety Improvements - Sidewalk Program project; and
WHEREAS, this project consists of on-call sidewalk reconstruction, curb ramp construction, crosswalk improvements, installation of medians, pavement markings and basic traffic signal equipment;  and
WHEREAS, it is necessary to authorize an amendment to the 2012 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for this project; and
 
WHEREAS, this ordinance authorizes the Director of Public Service to enter into contract with G&G Cement Contractors for the construction of the Pedestrian Safety Improvements - Sidewalk Program project.
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction in that it is immediately necessary to enter into said contract in order to maintain the project schedule and to provide the highest level of pedestrian safety possible thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to enter into contract with G&G Cement Contractors, 2849 Switzer Avenue, Columbus, OH, 43219 for the construction of  the Pedestrian Safety Improvements - Sidewalk Program Project in the amount of up to $203,000.00 or so much thereof as may be needed, for the Division of Mobility Options in accordance with the specifications and plans on file in the Office of Support Services, which are hereby approved; and to obtain and pay for the necessary inspection costs associated with the project up to a maximum of $51,000.00.
 
SECTION 2.  That the 2012 Capital Improvements Budget is hereby amended as follows:

SECTION 4.  That for the purpose of paying the cost of the contract and inspection, the sum of up to $254,000.00 or so much thereof as may be needed, is hereby authorized to be expended from the Streets & Highways G.O. Bonds Fund, No. 704, for the Division of Mobility Options, Dept.-Div. 59-10 as follows:

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
