Title: To authorize the Director of Public Service to modify and increase the contract for the design of the Short North Streetscape Improvement contract for the Division of Planning and Operations; to amend the 2012 C.I.B; to authorize the transfer and expenditure of $63,726.04 within the Streets and Highways G.O. Bonds Fund; and to declare an emergency. ($63,726.04)
Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to modify and increase an existing contract with Korda Nemeth Engineering, Inc, for the Short North Streetscape Improvement contract in an amount up to $63,726.04.  
 
Work performed to date for this project includes the preliminary engineering study recently began and a site walk through with the primary stakeholders of the project.  The consultant has been collecting data to begin considering alternatives.
 
Work to be performed as part of this modification consists of  extending the project to 9th Avenue with the same scope as the original contract.  Considerations should include but not be limited to street lighting, conversion of strain pole supported signal facilities to mast arm, conversion of overhead utilities (including private utility company facilities and City-owned facilities) to underground, curb extensions, sidewalk, bikeways, ADA compliance, and walkability improvements.
This is a planned modification.  The cost of the modification was negotiated based on existing contracts rates.

Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Korda Nemeth Engineering, Inc.

The contract compliance number for Korda Nemeth Engineering, Inc. is 310922991 and expires 7/6/13.
3.  FISCAL IMPACT
Funding for this modification is available within the Streets and Highways G.O. Bonds Funds Fund.  
 
4.  EMERGENCY DESIGNATION
The Department of Public Service is requesting City Council to enact this legislation as an emergency measure, in order to allow for the work in this modification to proceed and the schedule for this project to be maintained.

Body
WHEREAS, contract no. EL012458, in the amount of $500,000.00 was authorized by ordinance no. 0157-2012, passed by City Council February 13, 2012, executed February 24, 2012 and approved by the City Attorney on February 28, 2012; and
WHEREAS, the Department of Public Service has determined it to be in the City's best interest to modify the subject contract for purpose of extending the project to 9th Avenue with the same scope as the original contract; and
WHEREAS, this ordinance authorizes the first modification to the Short North Streetscape Improvement contract in an amount up to $63,726.04; and
WHEREAS, the total contract amount including this modification is $563,726.04; and
 
WHEREAS, it is necessary to amend the 2012 Capital Improvement Budget to establish sufficient authority for this modification; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that the contract should be modified and increased  immediately so that the work to be performed as part of this modification can proceed and the project schedule maintained, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL012458, with Korda Nemeth Engineering, Inc, 1650 Watermark Drive, Suite 200, Columbus, OH 43215, by up to $63,726.04 for additional work in accordance with the terms as shown on the modification on file in the Office of Support Services.
SECTION 2.  That the 2012 Capital Improvement Budget be amended as follows to provide sufficient authority for this modification:

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
