Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Service to execute a construction contract modification with Thompson Excavation, Ltd. for the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation project.
This contract modification will allow the Department of Public Service to change the project scope of this existing contract for purposes of non-performing previously scoped work on the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation project and applying non-performed construction pay items to the reconstruction of the brick pavement, new sidewalk, sidewalk rehabilitation, and construction of ADA ramps on Elm Street between North Front Street and Wall Street.
Work to be non-performed on the project consists of the rehabilitation of Pearl Street between Hubbard Avenue and Prescott Street. This work is being non-performed due to an ongoing project "The Hubbard." Due to the development of this project it is in the best interest of the City to plan for future rehabilitation of this portion of the Street by budgeting this expense in future Capital Improvement Budgets or coordinating with developers to perform this work.
The original contract amount authorized by ordinance 1422-2011 and executed November 7, 2011 is $599,919.21 (EL012179)
This modification changes the scope of the project to allow funding from the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation contract and inspection encumbrance(EA023740) to be utilized for construction and inspection of the rehabilitation of Elm Street from Front Street to Wall Street.
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Thompson Excavation, Ltd.
2. CONTRACT COMPLIANCE
Thompson Excavation, Ltd. contract compliance number is 522451675 and expires 5/19/13.
3. FISCAL IMPACT
There is no additional funding required for this modification. This modification authorizes funding for the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation project to be utilized for other needed brick rehabilitation work on Elm Street.
4. EMERGENCY DESIGNATION.
Emergency action is requested in order to make funding for this rehabilitation project available for the improvement of Elm Street according to the project schedule.

WHEREAS, contract no. EL012179 was authorized by ordinance no. 1422-2011, passed by City Council October 3, 2011, executed November 7, 2011 and approved by the City Attorney on November 8, 2011; and
WHEREAS, the Department of Public Service has determined it to be in the City's best interest to modify the subject contract to nonperform work on a portion of Pearl Street and add work on Elm Street; and
WHEREAS, the work on the Pearl Street brick rehabilitation project will be nonperformed due to the development of "The Hubbard" project which is adjacent to the construction limits of the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation project; and
WHEREAS, as part of this scope modification funding which was to be used for Pearl Street will now be utilized for the rehabilitation of Elm Street from front Street to Wall Street; and
WHEREAS, this ordinance authorizes the Director of Public Service to modify the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation contract by change order to include work on Elm Street and to utilize funding established for construction inspection on Pearl Street to be used for the work on Elm Street; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Design and Construction in that the funding should be authorized immediately to allow the contractor to begin work authorized by this modification, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Public Service be and is hereby authorized to modify the scope of contract no. EL01012179 with Thompson Excavation, Ltd, 6182 Winchester Road, Carroll, Ohio, 43112 for the Brick Rehabilitation - Pearl Street - Short North Brick Rehabilitation project to include rehabilitation of Elm Street from Front Street to Wall Street and to authorize the use of inspection funds for this work for the Division of Design and Construction.
SECTION 2. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
