Title: To authorize the Director of Public Service to accept and execute a grant agreement with the Ohio Department of Transportation for the Share the Road program; to authorize the Director of Public Service to execute a professional service contract modification with EMH&T for the Pedestrian Safety Improvements - Olentangy River Road Shared Use Path contract; to appropriate $150,000.00 within the Federal/State Highway Engineering Fund; to authorize the appropriation and expenditure of $150,000.00 from the Fed/State Highway Engineering Fund for the Division of Mobility Options; and to declare an emergency. Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to accept the Share the Road grant and execute a grant agreement with the Ohio Department of Transportation for The Share the Road Grant and execute a professional services contract modification with Evans Mechwart Hambelton & Tilton, Inc. (EMH&T) to modify and increase the Pedestrian Safety Improvements - Olentangy River Road Shared Use Path contract in the amount of $150,000.00.  
 
Work originally included in this contract consists of tasks such as provision of traffic analysis, public outreach and involvement, conceptual designs and construction plans for various bikeway projects, including updating the City's Share the Road Program.  The improvements are mostly within the right-of-way, and  consist of projects identified in the Bicentennial Bikeways Plan such as shared use paths, bike lanes, and shared routes, as well as communications and public involvement related to bicyclist education and engagement in support of these projects.
As part of this contract, work was included for the Share the Road Program.  Share the Road is themed on safety and rules of the road and is an effort to encourage safety and awareness by all roadway users by staying alert, respecting the rights of others, and knowing and complying with traffic.   
 
It has been determined that it is in the best interest of the City to modify and increase this contract to perform additional work within the same project scope utilizing Highway Safety Program(HSP) funding which was granted to the City by the Ohio Department of Transportation.  This will provide additional funding to continue the education of the Public of the purpose of the Share the Road Program.  The Ohio Department of Transportation designated name for this project is FRA-Columbus-Share the Road, PID 93175.  ODOT may use statewide or offer to other jurisdictions the form and format of the educational and outreach program created through this grant.
The amount of the original contract was $533,000.00 (City Auditor's Contract No. EL011145, authorized by Ordinance No. 1363-2010)
The amount of this, the first modification, to the contract is $150,000.00.  
The total amount of this contract, including this modification, is $683,000.00
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against EMH&T.
2.  CONTRACT COMPLIANCE
EMH&T's contract compliance number is 310685594 and expires 9/22/13.
3.  EMERGENCY DESIGNATION
Emergency action is requested to continue the efforts of the Share the Road program to provide for the safety of the travelling public.
4.  FISCAL IMPACT
This ordinance authorizes the Director of Public Service to accept the Share the Road grant from the Ohio Department of Transportation.  This ordinance also authorizes the  appropriation and expenditure of these grant funds for this contract modification.

WHEREAS, ordinance 1363-2010, passed by City Council October 4, 2010, authorized the Director of Public Service to enter into contract with Evans Mechwart Hambelton & Tilton, Inc. for the Pedestrian Safety Improvements - Olentangy River Road Shared Use Path contract (City Auditor's Contract No. EL011145); and
 
WHEREAS, this contract was executed October 13, 2010 and approved by the City Attorney on December 6, 2010; and
WHEREAS, as part of this contract, work was included for the Share the Road Program; and
WHEREAS, the Share the Road Program is themed on safety and rules of the road and is an effort to encourage safety and awareness by all roadway users by staying alert, respecting the rights of others, and knowing and complying with traffic rules; and
WHEREAS, the Ohio Department of Transportation has awarded grant funding to the Department of Public Service for the purpose of funding Share the Road Program efforts; and
WHEREAS, this ordinance authorizes the Director of Public Service to accept this grant from the Ohio Department of Transportation and execute the grant agreement; and
WHEREAS, a satisfactory proposal has been submitted by EMH&T; and
WHEREAS, the Director of Public Service has identified the need to modify the Pedestrian Safety Improvements - Olentangy River Road Shared Use Path contract to perform additional work within the same project scope utilizing the Share the Road grant funding; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Mobility Options, in that this legislation should go forth immediately to maintain the overall design schedule in order to have plans available for construction of projects, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of the Department of Public Service be and is hereby authorized to modify and increase Contract No. EL011145 with EMH&T, 5500 New Albany Road, Columbus, OH, 43054 in the amount of up to $150,000.00 or so much as may be needed for the Pedestrian Safety Improvements - Olentangy River Road Shared Use Path project.
SECTION 2. That Director of the Department of Public Service is authorized to accept the Share the Road grant from the Ohio Department of Transportation and execute the agreement for this grant.
SECTION 3. That the sum of $150,000.00 be and is hereby appropriated from the unappropriated balance of the Fed/State Highway Engineering Fund, Fund 765, and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2012,   as follows:

This appropriation is effective upon receipt of executed grant agreement.
SECTION 4.  That for the purpose of paying the cost of this contract modification, the sum of up to $150,000.00 or so much thereof as may be needed, is hereby authorized to be expended from the Fed/State Highway Engineering Fund, Fund 765 for the Division of Mobility Options, Dept-Div 59-10, as follows:

SECTION 5.  That at the end of the grant period, any repayment of unencumbered balances required   by the grantor is hereby authorized and any unused City match monies may be transferred back to the City fund from which they originated in accordance with all applicable grant agreements.  
 
SECTION 6.  That funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated.
SECTION 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 8.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
