Title: To authorize the Director of Public Service to modify the Collection Services of Yard Waste & Recyclables Contract with Rumpke of Ohio, Inc., to add collection of City-owned recycling receptacles as a service covered by the contract; to authorize the expenditure of $20,000.00 to pay for this service through February 28, 2014; and to declare an emergency. BACKGROUND
 
This ordinance authorizes the Director of Public Service to modify the Collection Services of Yard Waste & Recyclables Contract with Rumpke of Ohio, Inc., to add collection of City-owned recycling receptacles located in city right of way as a service covered by the contract, and to authorize the expenditure of $20,000.00 to pay for this service through February 28, 2014.  In July of 2011 a bid was issued for collection services of yard waste and recyclables.  Ordinance 0088-2012 authorized the Director of Public Service to execute a 5-year contract for yard waste and recyclables collection services with Rumpke of Ohio, Inc.  
 
The recycling receptacles that will be initially serviced under this ordinance were purchased as part of Mayor Michael B. Coleman's Get Green Columbus initiative.  Ordinance 0535-2013 authorized the purchase of these receptacles.  The receptacles are expected to ship from SiteScapes (the manufacturer) approximately June 21, 2013.  They will be installed along both sides of the street from 333 W. Broad St. to 250 E. Broad Street, and from 410 S. High St. to 2661 N. High St.  Installation is expected to begin in June, 2013, and will be performed by the Department of Public Service, Division of Planning & Operations.
 
This type of recyclable collection route is new to the City.  Rumpke has agreed to do the collection as a pilot program for $20,000.00 through the end of February, 2014.  The pilot program will be used to determine if the collection service of these receptacles should continue as part of the Rumpke contracted service for yard waste and recyclables or if a bid for these services should be issued.  At this time the cost of this program cannot be estimated beyond the pilot period.  The amount to be expended for the Collection Services of Yard Waste & Recyclables Contract with Rumpke of Ohio, Inc., over the course of the 5-year contract now is as follows:
 
Year one amount: $5,740,678.26 (Ordinance 0088-2012, EL012445)
Year two amount: $5,980,862.44 (Ordinance 0976-2013 and this Ordinance)
Total contract amount through year 2: $11,721,540.70
Amount over 5 years: $30,135,293.98
 
Searches in the System for Award Management and the State of Ohio's Findings for Recovery List produced no findings against Rumpke of Ohio, Inc.
 
1. Contract Compliance
The contract compliance number for Rumpke of Ohio, Inc., is 311617611 and expires 01/09/2014.
 
2. FISCAL IMPACT
There is sufficient funding in the 2013 budget to pay for this expense.  The need to fund this collection for the remaining three years of the contract was noted in the recently submitted three-year budget plan.
 
3. EMERGERNCY DESIGNATION     
Emergency action is requested to allow approval of the contract modification in time to begin servicing the recycling receptacles when their installation begins.

Whereas, Mayor Michael B. Coleman has a Get Green Columbus initiative; and
 
Whereas, the recycling receptacles soon to be installed along Broad Street and High Street are a part of that initiative and will need to be serviced; and
 
Whereas, the City has an existing Collection Services of Yard Waste & Recyclables Contract with Rumpke of Ohio, Inc., that can be modified with City Council approval to include the collection of these type of recycling receptacles; and
 
Whereas, Rumpke of Ohio, Inc., has agreed to do the collection service of these recycling receptacles as a pilot program under the Collection Services of Yard Waste & Recyclables Contract for $20,000.00 through February 2014; and
 
Whereas, this year's expense can be funded by the Refuse Collection Division's 2013 General Fund budget; and
 
Whereas, an emergency exists in the usual daily operation of the Department of Public Service, Refuse Collection Division, in that it is immediately necessary to execute a contract modification to service the recycling receptacles that are about to be installed, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Service be and is hereby authorized to execute a contract modification with Rumpke of Ohio, Inc., 10795 Hughes Road, Cincinnati, Ohio, 45251, to add collection of City-owned recycling receptacles to the Collection Services of Yard Waste & Recyclables Contract.
 
SECTION 2.  The sum of $20,000.00 be and is hereby authorized to be expended from Fund 010, the General Fund, Department Number 59-02, Refuse Collection Division, Object Level One Code 03, Object Level Three Code 3336, OCA code 593566.
 
SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
 
SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 5.  That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
