Background:
Bid Bids were received by the Recreation and Parks Department on May 29, 2013 for the Cooke and Cremeans Parks Improvements Project as follows:

The work for which proposals are invited consists of the following base bid and alternates:
Base Bid Item #3: combined work of Item #1 and Item #2 for demolition, tennis courts, and asphalt paths for Cooke Park and demolition, asphalt paths, repair and paint existing shelter, basketball courts, and playground for Cremeans Park.
Alternate #3: installation of 375 feet of black ornamental 4' high fence at Cremeans Park.
Alternate #4: installation of 540 feet of 8' wide asphalt path at Cremeans Park.

Title
To authorize the City Auditor to transfer $350,000.00 within the voted Recreation and Parks Bond Fund 702; to amend the 2013 Capital Improvements Budget Ordinance 0645-2013; to authorize and direct the Director of Recreation and Parks to enter into contract with Pavement Protectors, dba M&D Blacktop Sealing, for the Cooke and Cremeans Park Improvements Project; to authorize the expenditure of $329,000.00 and a contingency of $21,000.00 for a total of $350,000.00 from the voted Recreation and Parks Bond Fund; and to declare an emergency. Body
WHEREAS, bids were received by the Recreation and Parks Department on May 29, 2013 for the Cooke and Cremeans Parks Improvements Project; and
WHEREAS, funds are being moved to alternate projects within Fund 702 to establish correct funding project detail location for the Cooke and Cremeans Parks Improvements Project; and
WHEREAS, the 2013 Capital Improvement Budget will be amended to reflect the fund transfers from projects within Fund 702; and
WHEREAS, the contract will be awarded to Pavement Protectors, dba M&D Blacktop Sealing, as the lowest and best responsive bidder; and
WHEREAS, an emergency exists in the usual operation of the Recreation and Parks Department that it is immediately necessary to enter into said contract so that work may proceed during the current construction season; NOW THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor is hereby authorized to transfer $350,000.00 within the voted Recreation and Parks Bond Fund 702 for the projects listed below:

SECTION 2. That the 2013 Capital Improvements Budget Ordinance 0645-2013 is hereby amended as follows in order to provide sufficient budget authority for this legislation.

SECTION 3. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Pavement Protectors, dba M&D Blacktop Sealing, for the Cooke and Cremeans Park Improvements Project.
SECTION 4. That the expenditure of $350,000.00 or so much thereof as may be necessary to pay the cost thereof, be and is hereby authorized from the voted Recreation and Parks Bond Fund 702 as follows:

SECTION 5. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this legislation.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or 10 days after passage if the Mayor neither approves nor vetoes the same.
