EXPLANATION

BACKGROUND:

The Columbus Recreation and Parks Department on behalf of the City of Columbus, Ohio, an Ohio municipal corporation (“City”), desires to enter into a license agreement (“License”) with The Columbus Recreation and Parks Community Recreation Council, an Ohio nonprofit corporation (“CRRCRC”). The License will permit CRRCRC to nonexclusively use, operate, maintain, and manage public tennis programs and educational activities (collectively, “Program”) at the City’s Champions Tennis Facility located at 3900 Westerville Road, Columbus, Ohio 43224 [Franklin County Tax Parcel ? 010-104558] (“Facility”). The City is unable to operate the Facility’s Program itself due to budgetary constraints; however, CRRCRC has been successfully operating the Facility’s Program since at least the year 2010, and the City continues to enjoy a good working relationship with CRRCRC.

The License has a term of two (2) years commencing February 28, 2014, and terminating February 29, 2016, unless otherwise terminating sooner as described under the License. CRPD reviewed and determined that it is in the City’s best interest to enter License with CRRCRC, because CRRCRC’s operation of the Facility’s Program does not incur the City any costs and is a benefit to the City, public, and local community. Therefore, this ordinance authorizes the City’s director of the Columbus Recreation and Parks Department to enter into the License Agreement, as approved by the Columbus City Attorney.

FISCAL IMPACT: Not applicable.

EMERGENCY JUSTIFICATION: Emergency action is requested so to not delay the benefit resulting from CRRCRC’s operation of the Program.
